PCR1991223APPROVAL OF CERTIFIED SURVEY MAP FOR CHESTER SPITZNER IN THE SW 1/4 OF SECTION 17 WHEREAS, a certified survey map has been submitted by Chester RESOLUTION #P.C. 223-91 Spitzner to create a parcel of land located in the SW 1/4 of Section 17, and requirements for this zoning regarding lot width and area have WHEREAS, this property is zoned RS-2, and the minimum been met, and WHEREAS, the required 40' right of way along Woods Road has been dedicated on the Certified Survey Map, and WHEREAS, the square footage of outbuildings on this property are in excess of that allowed in this zoning for this 1.840 acre division, and WHEREAS, Chapter 17 of the Zoning Ordinance, Section 2.02 (30), defines a lot as: The area of contiguous land bounded by lot lines, exclusive of land provided for public thoroughfare, and WHEREAS, Additional land is owned across the street by Mr. Spitzner of sufficient acreage to bring the outbuildings into compliance. THEREFORE BE IT RESOLVED, that the Plan Commission approve the Certified Survey Map for land division in the SW 1/4 of Section city engineers, payment of all applicable fees in Section 10 of 17, and recommend to the Common Council subject to approval of the land division ordinance. BE IT FURTHER RESOLVED, that any future proposed divisions of the property across the street, west of this parcel, be reviewed to assure outbuilding square footage compliance on this parcel at the time of the proposed division.
