PCR19911680 APPROVAL OF DEED RESTRICTIONS FOR COUNTRY BROOK ESTATES SUBDIVISION FOR DON MILLER AMENDED RESOLUTION #P.C. 168-91 for Country Brook Estates Subdivision located in the SE 1/4 of Section 16, and WHEREAS, Deed restrictions have been submitted by Don Miller the Plan Commission under the city's Planned Unit Development (P.U.D.) ordinance, and WHEREAS, The deed restrictions are required to be reviewed by WHEREAS, The deed restrictions provide for certain minimum building requirements and site improvements, and WHEREAS, These requirements do not conflict with the city's zone district requirements, and WHEREAS, Included in these restrictions is the requirement that a berm be maintained on the lots that front along Woods Road as was required by the Plan Commission. 0 deed restrictions for Country Brook Estates. THEREFORE BE IT RESOLVED, That the Plan Commission approve the BE IT FURTHER RESOLVED, That approval be subject to removal of upon sale of the last lot in the subdivision in paragraph 3, page the provision that termimtes the architectural control committee 4. BE IT FURTHER RESOLVE:D, That the resolution be amended as follows : 1-Pg. 2, Two-story dwelling have 1,000 sq. ft. on the first floor. Architectural Control Committee. This will be beneficial in the 2-Pg. 4, paragraph 3, tak:e last sentence out regarding ceasing of maintenance of the subdivision (entrance sign, etc.). 3-Pg. 7, the Architectural Control Committee shall stay in existence and not expire.
