PCR19911640 APPROVAL OF DEED RESTRICTIONS FOR LAKE FOREST ADDITION #1 RESOLUTION #P.C. 164-91 SUBDIVISION-PHASE I1 (SINGLE-FAMILY) IN THE SE 1/4 OF SECTION 8 AMENDED Restrictions for Lake Forest Addition #1 Subdivision-Phase I1 (Single-Family) in the SE 1/4 of Section 8, and WHEREAS, Robert Patch has submitted the Declaration of WHEREAS, Lake Forest Addition #l Subdivision is the second residential phase of a Planned Unit Development (P.U.D.), and WHEREAS, The City's P.U.D. regulations require the Plan Commission to review and approve the Declaration of Restrictions, and WHEREAS, These restrictions are identical to those that were development except for the rear yard setback which the developer reviewed and approved for the first phase of the residential had reduced to 20', and WHEREAS, Outlot 7 not be dedicated to the City but be part of OWNERS ASSOCIATION to: "In the event the City becomes an owner of the homeowner's association; add the wording on pg. 3, under B. any lot through tax delinquency process, the City shall not be liable for any homeowner's fees nor any special assessment against said lots. THEREFORE BE IT RESOLVED, That the Plan Commission approve the Declaration of Restrictions for Lake Forest Addition #1 Subdivision-Phase I1 (Single-Family) in the SE 1/4 of Section 8 subject to changing the rear yard setback to 20'.
