RESOLUTION #P.C. 145-91
vacate a portion of the City's Right-of-way (lake access)
WHEREAS, A petition has been submitted by Fritz Bauer to
extending from Jewel Crest Drive to Jewel Creek in the NW 1/4 of
Section 4, and
WHEREAS, Mr. Bauer has submitted a petition signed by property
owners in the area of this property in support of the vacation of
a portion of the road, and
WHEREAS, The portion of the road to be vacated is
approximately 50' x 50' and adjoins the petitioner's residence to
the east, and
WHEREAS, Access to Jewel Creek would still be provided from
Silver Drive to the remainder of the road, and
road Right of Way with a majority of the residents in the area
objecting on the basis that they would be denied access to the
creek.
WHEREAS, In 1988 a petition was denied to vacate the entire
the vacation of the roadway in the NW 1/4 of Section 4.
THEREFORE BE IT RESOLVED, That the Plan Commission disapprove
