PCR1990092RESOLUTION #P.C, 92-90 APPROVAL QF DECLARATION OF RESTRICTIONS AND THE SUBDIVIDER'S AGREEMENT FOR MEADOW GREEN WEST ADDITION NO. 1 GREG BOEAM AMENDED WHEREAS, The Declaration of Restrictions and Subdivider's Agreement for Meadow Green West Adddition No. 1 have been submitted, and WHEREAS, Meadow Green West Addition No. 1 is zoned RS- 2/OPD, and WHEREAS, The final plat was approved in Resolution 1IP.C. 59-90 subject to the applicant deeding the property to the city and constructing the bike path entirely at the developer's expense, and WHEREAS, The Subdivider's Agreement and Letter of Credit contain provisions for the bike path. THEREFORE BE IT RESOLVED, That the Plan Commission approve the Declaration of Restrictions and the Subdivider's Agreement for Meadow Green West Addition No. 1. BE IT FURTHER RESOLVED, That the approval is subject to: 1-The developer amending the Subdivider's Agreement to provide for a 10' wide asphalt bike path. 2-The developer amending the Declaration of Restrictions to provide for the transfer of architectural control to a committee which will continue to function through the life of the subdivision.
