PCR1990004APPROVAL TO REMOVE RESTRICTION FOR JOINT AMENDED RESOLUTION CP.C. 4-90 DRIVEWAY AT W188 S6775 GOLD DRIVE-BRUCE REBHOLZ WHEREAS, A request has been submitted to allow separate accesses for Lot 1 and 2 to Gold Drive, and WHEREAS, These lots were divided in 1983 and because of the high traffic on Gold Drive the Plan Commission approved the division subject to the adjoining drive to be restricted as shown on the survey, and WHEREAS, It is shown on the survey and the information was available to prospective buyers. THEREFORE BE IT RESOLVED, That the Plan Commission approve the request to allow separate accesses for Lot 1 and 2 to Gold Drive and recommend that the certified survey map be amended to remove the restriction of the joint drive. BE 1T FURTHER RESOLVED, That all legal fees to record the deed restriction changes will be paid by the petitioner, as well as any costs involved to move the culvert and that the neighbor’s culvert be left at the standard size as determined by the Department of Public Works.
