WHEREAS, An existing dwelling located at W195 S7130
Hillendale Drive was constructed as a two-family structure, and
WHEREAS, In 1974 the owner had requested that the building
become a single family because his relative was living in the
second unit and, therefore, the sewer charges should be for
single family, and
in area, and
that any non-conforming use had been lost because it was
conforming for at least 12 months, and
that the dwelling was to be used as a single family, and
duplex, and
as a duplex and have petitioned the city for re-zoning so that
the duplex may be a conforming use, and
WHEREAS, The lot size is approximately 17,000 square feet
WHEREAS,. In 1979 a letter was sent to the owner stating
WHEREAS, In 1980 letters were directed to the owner stating
WHEREAS, It is now being conveyed to a new owner as a
WHEREAS, They have been informed that it was not to be used
family dwellings where special circumstances of location, land
WHEREAS, Section 9.09 of the Zoning Ordinance permits two-
character or the type of existing use would contribute to or
improve the surrounding living and environmental characteristic
of the area.
THEREFORE BE IT RESOLVED, That the Planning Commission
recommend to the Common Council to rezone the property located at
W195 57130 Hillendale from RS3/0ED to RS3/0D.
