RESOLUTION #P.C. 32-88
RECOMMENDING APPROVAL OF REZONING - DANDELION PARK
FROM RS3/B2 TO RS3/B2/OPD
WHEREAS, The City has received a petition to amend the
district zoning map to place a planned development overlay on
approximately 30 acres in Section 9, and
WHEREAS, This development is to provide for 74 townhouse
units - 4 and 6 unit buildings, and
WHEREAS, The development will also include a mixed use
facility, and
WHEREAS, 74 units is below the maximum amount permitted
under the existing zoning with the OPD overlay, and
WHEREAS, The proposed development is consistent in all
respects to the spirit and intent of the ordinance and is in
conformity with the comprehensive plan and will not be contrary
to the general welfare of the City and immediate neighborhood.
THEREFORE BE IT RESOLVED, That the Plan Commission
recommend to the Common Council that the site formerly known as
Dandelion Park be rezoned in concept to an OPD with the following
exceptions:
1) That provisions for a turn around be placed on the end
of Lake Drive and that the proponents of the proposed development
demonstrate that they intend to start construction within a
reasonable time after receiving approval.
2) That a construction schedule be submitted which is to be
sati sfactory to the Common Council.
3) That the developer assure the Common Council that the
project appears to be economically sound and that adequate
financing is possible.
4) That a building, site and operation plan for the
lete site be submitted to the Plan Commission within 60 days. comp
