APPROVAL OF CONDITIONAL USE GRANT

MICHAEL LAACK - W125 S9738 NORTH CAPE ROAD
WHEREAS, Th e Plan Commission has received a petition for a
conditional use for the property addressed as W125 S9738 North
Cape Road, and
WHEREAS, This conditional use grant is for the purpose of
allowing an auto parts repair shop and not including storage of
junk, wrecks, or parts, and
WHEREAS, It is necessary to place conditions so that such
grant shall have no adverse affect on the health, general
welfare, safety and economic prosperity of that area and to
eliminate any possible hazardous, harmful, noxious offenses or
nusiance that would be appropriate to carrying out the intention
of the conditional use grant.
THEREFORE BE IT RESOLVED, That the Plan Commission approve
the conditional use grant with the following conditions:
1) HOURS OF OPERATION - 8:OO A.M. TO 6:OO P.M. Monday
through Friday and 8:00 P.M. to 1:OO P.M. on Saturday.
2) That the business he limited to the sale and service of
auto parts.
3) That there shall be no outdoor storage of supplies and
materials.
4) That any customers vehicle left overnight for repair
shall be parked inside the building.
5) That the lawn, trees. and shrubs indicated on the

landscaping plan shall be installed prior to June 1, 1988.
6) That the proposed driveway and parking area be surfaced
with asphalt and/or concrete prior to June 30, 1988.
7) That the applicant provide the City with a $5,000
Letter of Credit subject to approval by the City Attorney to
cover the total cost of site improvements (paving/landscaping).
