RECONSIDERATION FOR THE PARKING OF TRUCK

RESOLUTION CP.C. -159-87
WHEREAS, The Plan Commission in Resolution #P.C. 212-86,
Approval of Parking Dump Trucks/Tractor-Lawrence Yaeger. and in
Resolution #P.C. 36-87, Approval of Parking Dump Trucks/Tractor-
Lawrence Yaeger and Resolution #P.C. 94-87, Consideration for the
Parking of Trucks - Yaeger-W2O7 S8050 Hillendale had denied all
resolutions, and
WHEREAS, The petitioner had appealed to the Board of
Appeals under Section 3.08 of the zoning ordinance, and
WHEREAS, The Appeal Board on May 28, 1987 in their
deliberation felt that the petitioner should be given time to
find a new location to park the trucks, and
WHEREAS, The Plan Commission is reconsidering the parking
of trucks for Lawrence Yaeger at W207 S8050 Hillendale.
THEREFORE BE IT RESOLVED, That the Plan Commission approve
the parking of trucks at W207 S8050 Hillendale for the period
from October 1, 1987 until September 30, 1988 under the following
conditions :
1. The permit will be reviewed 90 days prior to the
October 1 renewal deadline each year.
2. At any time the City takes action not to renew said
permit, the permittee has 90 days from the date of the renewal
permit of October 1 in which to discontinue the permitted use.
3. Only the following trucks may be parked upon the real
estate subject to this permit:
A. No more than four (4) tri-axle vehicles.
B. A list of vehicles identified by make and number be
submitted.
C. Statement identifying the make and number of the
vehicles stored and time period of storage.
4. The hours of operation shall be from 6:OO A.M. to 7:OO
P.M. six days a week, Monday through Saturday except that there
shall not be a limit as to hours of operation for trucks when
they are required for snow removal.
5. All trucks shall enter and leave the property from
Highway 24 and Hillendale Road.
6. NO loaded trucks shall be parked on the property at any
time .
7. All trucks shall be parked inside.
8. This permit will be subject to the review and approval
of the City Attorney.
9. When the area becomes sewered or predominately
developed, whichever comes first, the petitioner will comply with
the 90 day renewal hearing and 90 day discontinued use deadlines
and cease the operation of parking and storing trucks on this
property.
