RESOLUTION #P.C. 82-87
WHEREAS, It was proposed to rezone the Weseljak property
and change the zoning in the NW 1/11 Section 36 from agricultural
to 1-2, and
WHEREAS, The text must be amended to allow a sanitary
landfill in the 1-2 district, and
WHEREAS, The use proposed in this 1-2 zoning district is
for a sanitary landfill, and
WHEREAS, The Common Council in Resolution f122-87 denied the
request for rezoning and stated reasons for this denial, and
WHEREAS, The Common Council returned the resolution
recommending denial to the Plan Commission and requested reports
from the city engineers and city planner regarding the proposed
site, and
WHEREAS, These reports have been received.
THEREFORE BE IT RESOLVED, That the Plan Commission reaffirm
their recommendation to the Common Council that the petition to
rezone the Weseljak property in the NW 1/11 of Section 36 and
amending the text permitting a sanitary landfill be denied based
on the following reasons:
1) That the City Planner has determined that this landfill
is incompatible with the long term Comprehensive Plan of the
City.
2) This landfill will have detrimental affects on both the
quality of the community and the economic value of property in
the City.
3) The possible contamination of ground water could affect
the quality of the lake.
4) Traffic volume would be increased.
5) Possible contamination of wells surrounding the
landfill site.
6) The City Engineers have determined that ground water
monitoring makes it impossible to determine the exact source of
any ground water that could contaminate wells.
7) That there is a lack of a definite plan of operation
and specifications for proceeding with the project.
8) There is a lack of proof for necessity of siting of
landfill with respect to alternative methods or location of waste
disposal.
