PLACING CONDITIONS ON CONDITIONAL USE GRANT
JACK CLOCKNER EXTRACTIVE PERMIT
WHEREAS, A petition for a condit
submitted by Jack Clockner for a legal
ional use grant has been
nonconforming extractive
operation, and
WHEREAS, It is the responsibility of the Plan Commission to
place certain conditions on this operation, and
WHEREAS, The public hearing was held on January 6, 1987
where the concerns of the neighbors were heard, and
WHEREAS, Reports from the City Attorney and DNR have been
received.
THEREFORE BE IT RESOLVED, That the Plan Commission approve
the conditional use grant with the following conditions:
1. Hours of operation - 7 A.M. to 7 P.M. Monday through
Saturday - no Sunday operation.
2. That there will be no junk vehicles parked or stored in
the excavated area.
3. That any pumping done that would adversely affect any
of the surrounding wells, such pumping shall cease immediately.
4. There will be no blasting, crushing, washing of sand or
gravel or other processing other than the initial removal of
material.
5. A restoration bond of in the amount of $25,000 will be
secured from Mr. Glockner for the site.
6. That the ponds will not exceed 15' in depth.

7. That the site will be graded to contour with slopes not
greater than 1' to 4'.
8. That any additional equipment used in the extractive
operation other than listed below must have Plan Commission
approval :
Two (2) dump trucks
One (1) end loader
Two (2) drag lines
9 That the permit be reviewed on a yearly basis.
