APPROVAL OF SUBDIVIDER'S AGREEMENT
DURHAMSWOOD ADDITION #1
w#$WE4%, The subdivider's agreement has been submitted by
Robert Klenz: developer, and
WHEREAS, The plan for all improvements has been submitted,
and
WHEREAS, The declaration or restrictions are part of the
deed restrictions and referred to the City attorney, and
WHEREAS, The final plat has been approved in P.C. 173-86.
THEREFORE BE IT RESOLVED, That the Plan Commission approve
the subdivider's agreement subject to approval by the City
0 attorney and recommend approval to Common Council.
BE IT FURTHER RESOLVED, That this resolution is subject to
the receipt of the plan review fee, the approval of the city
engineers and $3,400 in lieu of park dedication.
BE IT FURTHER RESOLVED, That the Plan Commission recommends
to Common Council the the subdivider's agreement provides a
letter of credit of $15,000 to cover any uncompleted phase of the
preliminary plat.
BE IT FURTHER RESOLVED, That the first sentence of #11 of
the Deed Restrictions be deleted in the subdivider's agreement.
