APBRBVBL 4NB RECOMMENDING APPROVAL FOR
RESOLUTION #P.C. 186-86
EXTWBCTIVE PERMIT-CREATIVE RESOURCE VENTURES LTD.
W#BREA$, It is proposed to extract clay from the Weseljack
property in the NE and the NW quarter of Section 36, and
WHEREAS, It is proposed to extract clay and recontour the
land on 45 acres of the 118.5 acres owned by the Weseljack's, and
WHEREAS, The agricultural zoning will remain unchanged,
and
WHEREAS, A petition for conditional use has been submitted
and a public hearing held on October 7, 1986, and
WHEREAS, The Plan Commission shall within 30 days after the
public hearing report and recommend to the Common Council, and
WHEREAS, The Common Council shall within 10 days after
receipt of the recommendation from the Plan Commission either
grant or deny the proposed extractive operation, and
WHEREAS, If the Plan Commission denies the application for
approval the Common Council shall require a favorable vote of all
council members.
THEREFORE BE IT RESOLVED, That the Plan Commission approve
the conditional use and recommend approval to the Common Council
with the following conditions:
1) That the initial permit is not to exceed three years
and reviewed each and every year
2) That adequate dust control be provided and that the
drive leading to the site be asphalted for at least 500' and kept
in dust free condition
3) Hours of operation will be 7:OOA.M. to 6:OOP.M.
4) No putrescible material will be used in the restoration
of the site or in any future use
5) That the site at each restoration phase be provided
with a minimum of 8" of topsoil, seed, fertilizer and mulch
before removing clay in the next phase.
6) Stockpiles of top soil shall be seeded, fertilized, and
mulched.
7) Approved plans for the sediment basin:
a) size (capacity)
b) water elevation of outlet control
c) bottom elevation of sediment basin
d) assumed elevation of ground water
e) capacity of sediment basin of assumed ground water
to the planned water elevation.
f) sediment reduction stated in percent for:
a - present condition
b - planned condition
g) fencing and gate,
8) $5,000 Bond or Letter of Credit approved by City -
Attorney - .r
a) guaranteeing maintenance of the sedimentation basin
b) financial security for final closure and restoration -
9) _Acceleration/Deacceleration lanes at the entrance to
10) That Creative Resource Ventures Ltd. shall be required
