RESOLUTION #P.C. 68-86
APPROVAL OF EXTENSION TO REMOVE CLAY FROM THE LEKFIELD PROPERTY
WHEREAS. The permit granted in #P.C. 41-83 has expired, and
WHEREAS, Don DeBack Grading has submitted a request for an
extension, and
WHEREAS, The Restoration Plan was submitted on March 9,
1987, and
WHEREAS, A new irrevocable bond with an unlimited duration
to insure the restoration is completed must be submitted.
THEREFORE BE IT RESOLVED, That the Plan Commission approve
the extension of the permit for one year and that the application
for renewal must be submitted 70 days prior to May 1st of each
year.
BE IT FURTHER RESOLVED, That this approval is subject to
the submitting of a restoration bond in amount approved by Plan
Commission and in a form to be approved by the City Attorney.
BE IT FURTHER RESOLVED, That this does not usurp the
authority of the Common Council or Public Works Committee
requiring the Highway Width bond.
BE IT FURTHER RESOLVED, That this approval is contingent
upon an agreement executed between the City and the owner.
BE IT FURTHER RESOLVED, That the proposed amended agreement
between-the City of Muskego, Don De Back Grading, Inc. and Donald
and Eva Lekfield be submitted to the Common Council and City
Attorney for approval.
