DENIAL OF LEGAL LOT STATUS
ROBERT YAEGER
WHEREAS, The Common Council has received a plan for
determination of status for lot 12 in the unrecorded Zieglers Oak
Park Subdivision from Robert Yaeger of Wauwatosa Realty, agent
for Ben Homer, and
of 13,333 square feet and 73.3 average width, and
area, and
9600 square feet in area, and
adjoining lot to the east (tax key #2281.983), and (tax key fl2281 .982) and held in the same ownership as the
WHEREAS, The home on the lot to the east is located 5.98
feet from the lotline, and it would not be in best interest of
the City to redivide that lot, and
value of $5,700.00
WHEREAS, The cottage (tax key fl2281 .982) has an assessed
WHEREAS, There has been no guideline adopted for
nonconforming lots.
THEREFORE BE IT RESOLVED, That the Plan Commission of the
City of Muskego does hereby recommend to the Common Council that
because of the average width being less than 50% of that required
and only 28% of the area, the Plan Commission recommend to the
Common Council denial of the legal lot status.
WHEREAS. This is zoned RS-2 OLS which requires a lot size
WHEREAS, This lot is substandard in both average width and
WHEREAS, This lot has an average width of 30 feet and is
WHEREAS, There is an existing home and garage on this lot
