PCR1981100RESOLUTION #P. C. 100-81 CLARIFICATION OF B-2 AND RS-2 ZONING HWY. 24 and RACINE AVENUE WHEREAS prior to June 26, 1973, a parcel of land lying Schaefer property was zoned B-2, and southwest of Lions Park Drive and encompassing a portion of the WHEREAS on April 12, 1973, Mr. Alvin Schaefer petitioned the Common Council to rezone a prescribed area located southwest of Lions Park Drive from B-2 to RS-2 to permit a residence to be located along Lions Park Drive, and WHEREAS the description of the area to be rezoned removed all the B-2 zoning southwest of Lions Park Drive, except that portion lying directly northwest of Hwy. 24 east of Racine Ave., and the description also indicated that the centerline of the newly constructed Racine Avenue would be the southwesterly boundary of the proposed rezoning, and WHEREAS the discrepancy in the petitioner's description requires that the Plan Comission clarify the action that was taken on June 26, 1973, and that the zoning map be corrected to reflect the intent of the Plan Commission and the petitioner. THEREFORE BE IT RESOLVED that the Plan Commission of the City of Muskego, in order to clarify the action of the City taken on June 26, 1973, does hereby declare the following 1. That the Plan Commission reaffirms the fact that the area northwest of Hwy. 24 lying between Lions Park Drive and Racine Avenue and not included in the description of the area to be rezoned in 1973 to RS-2 is properly zoned B-2 2. The balance of the area previously zoned B-2 was in fact rezoned RS-2 by the action of the Plan Commission and the Common Council in June, 1973. BE IT FURTHER RESOLVED that the planning department is directed to correct the official Zoning District Map of the City of Nuskego to show the area along Hwy. 24 between Lions Park Dr. of Racine Avenue to be RS-2. and Racine Ave. as being zoned B-2 and the area lying southwest City of Muskego Plan Comnission Adopted DEC. 1 148f Defeated Deferred * jm 12/81
