PCR1979140RESOLUTION #P. C. 140-79 A RESOLUTION DESIGNATING THE PROPOSED BOUNDARIES OF TAX INCREMENTAL DISTRICT NUMBER FIVE CITY OF MUSKEGO WHEREAS, Section 66.46 of the Wisconsin Statutes (the "Tax Increment Law") provides the authority and establishes the procedures for creating tax incremental districts; and WHEREAS, the northern portion of the City is in need of fill, storm sewer drainage and additional capacity in the sanitary sewer treatment facilities; and planning work, scheduled, gave public notice of, and on May 1, 1979, held a public hearing on the creation of the proposed tax incremental district and the proposed boundaries thereof, in accordance with the procedures specified in the Tax Increment Law; and WHEREAS, the Planning Commission, after completing the preliminary WHEREAS, prior to its publication, a copy of the notice of the Waukesha County Board of Supervisors and the District Board of the said public hearing was sent to the chief executive officers of the Waukesha County Vocational, Technical and Adult Education District (the other entities having the power to levy taxes on property located within the proposed district) and the School Board of the Muskego- Norway School District (the school board of the school district which with the procedures specified in the Tax Increment Law; and includes property located within the proposed district), in accordance ing the said public hearing, determined that the creation of a tax incremental district within the area described by the boundary description attached to this resolution will provide the City of Muskego with a viable method of financing the costs of needed public improvements within the said area, thereby creating incentives and opportunities for appropriate private development, including new development and improvement of existing development, which will contribute to the overall development of the northern portion of the City; and WHEREAS, the Planning Commission, after due consideration follow- WHEREAS, the City's consulting engineer has reported that the total area of the proposed district is no more than 102.17 acres and the total area of the proposed district that is blighted as. defined acres; and in Wisconsin Statutes, Section 66.46(2) (a) is no less than 89.17 WHEREAS, in accordance with the procedures specified in the Tax Increment Law, before the Common Council may create any tax boundaries of such district and submit its recommendation concerning incremental district, the Planning Commission must designate the the creation of such district to the Common Council; NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF MUSKEGO, as follows: i . . That the Planning Commission hereby designates the boundaries specified in the boundary description attached to this resolution as Exhibit A hereof, and entitled "Boundary Description Of Tax Incremental District Number Five, City of Muskego", as the boundaries of the said Tax Incremental District Number Five, and recommends that the said district be created by the Common Council of the City of Muskego within the area enclosed by the said boundaries. 2. That the Planning Commission hereby recommends that the Common Council adopt the resolution attached to this resolution as Exhibit B hereof, and entitled "A ResolutiOn Creating, Describing and Making Certain Findings Concerning Tax Incremental District Number Five, City of Muskego", and thereby formally create the said district as of January 1, 1979, in accordance with the provisions of the Tax Increment Law. provide the Mayor and Common Council with certified copies of this resolution, upon its adoption by the Planning Commission. 3. Pursuant to the Tax Increment Law, there is hereby created in the City of Muskego a tax incremental district, to be known as "Tax Incremental District Number Five, City of Muskego", the boundaries of which shall be those recommended to the Common Council by the Planning Commission, as specified in the attached Exhibit A. 1979. 2. The said tax incremental district is created as of January 1, 3. The Common Council hereby finds and declares that: the said tax incremental district is a "blighted area" (a,) Not less than 25%, by area, of the real property within within the meaning of Section 66.46(2) (a) of the Wisconsin Statutes; and (b) The improvement of such area is likely to enhance significantly the value of all of the other real property in the said tax incremental district; and (c) The aggregate value of equalized taxable property of the said tax incremental district, together with that of Tax Incremental District Number One, Tax Incremental District Number Two, Tax Incremental District Number Three, Tax Incremental District Number Four, Tax Incremental District Number Six and Tax Incremental District Number Seven, does not exceed 5% of the total value of equalized taxable property within the City of Muskego, there being no more tax incremental districts in the City of Muskego. .~ ~ 4. The Planning Commission is hereby authorized and directed to prepare a Project Plan for Tax Incremental District Number Five, pursuant to the provisions of Section 66.46(4) (d) of the Wisconsin Statutes, and to submit said Plan to the Common Council for its review and approval. 5. The City Clerk is hereby authorized and directed to apply to the Wisconsin Department of Revenue, in such form as may be prescribed, pursuant to the provisions of Section 66.46(5)(b) of the Wisconsin for a "Determination of Tax ,Incremental Base", as of January 1, 1979, Statutes. 6. The City Assessor is hereby authorized and directed to ideiitify upon the assessment roll returned an? examined uzder Section 70.45 of the Wisconsin Statutes, those parcels of property which are within Tax Incremental District Number Five, specifying thereon the name of the said tax incremental district, and the City Clerk is hereby authorized and directed to make similar notations on the tax roll made under Section 70.65 of the Wisconsin Statutes, pursuant to Section 66.46(5)(f) of the Wisconsin Statutes.
