RESOLLITION BP. c. 138-79 A RESOLUTION DESIGNATING THE PROPOSED BOUNDARIES CITY OF MUSKEGO OF TAX INCREMENTAL DISTRICT NUMBER THREE WHEREAS, Section 66.46 of the Wisconsin Statutes (the "Tax ,~ncrement Law") provides the authority and establishes the procedures for creating tax incremental districts; and WHEREAS, the Planning Commission, after completing the preliminary planning work, scheduled, gave public notice of and, on March 20, 1979, held a public hearing on the creation of the proposed tax incremental district and the proposed boundaries thereof, in accordance with the procedures specified in the Tax Increment Law; and WHEREAS, prior to its publication, a copy of the notice of the public hearing was sent to the chief executive officers of the Waukesha County Board of Supervisors, the District Board of the Waukesha County Vocational, Technical and Adult Education District and to the Chairman of the Board of District Commissioners of the Little Muskego Lake Protective and Rehabili- tation District (the other entities having the power to levy taxes on pro- Muskego-Norway School District (the school board of the school district perty located within the proposed district) and the School Board of the with the procedures specified in the Tax Increment Law; and which includes property located within the proposed district), in accordance z .!. That the Planning Commission hereby designates 'the boundaries Exhibit A hereof, and entitled "Boundary Description Of Tax Incremental District Number Three, City of Muskego", as the boundaries of the said Tax Incremental District Number Three, and recommends that the said district be created by the Common Council of the City of Muskego within the area enclosed by the said boundaries. 2. That the Planning Commission hereby recommends that the Common Council adopt the resolution attached to this resolution as Exhibit B hereof, and entitled "A Resolution Creating, Describing and Making Certain Findings Concerning Tax Incremental District Number Three, City of Muskego", and thereby formally create the said district as of January 1, 1979, in accordance with the provisions of the Tax Increment Law. 3. That the City Clerk is hereby authorized and directed to provide the Mayor and Common Council with certified copies of this resolution, upon its adoption by the Planning Commission. I Exhibit B A RESOLUTION CREATING, DESCRIBING AND MAKING CERTAIN FINDINGS CONCERNING TAX INCREMENTAL DISTRICT NUMBER THREE, CITY OF MUSKEG0 0 WHEREAS, the development of industrial sites in the City of Muskego is recognized as a major need of the City; and WHEREAS, the City of Muskego desires to create a tax incremental district, in accordance with the provisions of Section 66.46 of the Wisconsin Statutes (the “Tax Increment Law“), in order to provide a viable method of financing the costs of needed public improvements within the said district and thereby create incentives and opportuni- ties for appropriate private development, including new development development of industrial sites; and and improvement of existing development, which will contribute to WHEREAS, in accordance with the procedures specified in the Tax ‘Increment Law, the Planning Commission, on March 20, 1979, held a public hearing concerning the proposed creation of a tax incremental district and thereafter designated the boundaries of the proposed tax incremental district and recommended to the Common Council that the said boundaries, as specified in the boundary description attached it create such tax incremental district within the area enclosed by to this resolution as Exhibit A hereof, and entitled “Boundary Description of Tax Incremental District Number Three, City of Muskego”; and said public hearing was sent to the chief executive officers of the WHEREAS, prior to its publication, a copy of the notice of the Waukesha County Board of Supervisors and the District Board of the Waukesha County Vocational, Technical and Adult Education District (the other entities having the power to levy taxes on property located within the proposed district) and the School Board of the Muskego- Norway School District (the school board of the school district which includes property located within the proposed district), in accordance with the procedures specified in the Tax Increment Law; NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF MUSKEGO, as foilows: 1. Pursuant to the Tax Increment Law, there is hereby created a tax incremental district, to be known as “Tax Incremental District Number Three, City of Muskego”, the boundaries of which shall be those recommended to the Common Council by the Planning Commission as specified in the attached Exhibit A. - 2. The said tax incremental district is created as of January 1, 1 1979. 3. The Common Council hereby finds and declares that: (a) Based upon its consulting engineer's findings, not less than 25%, by area, of the real property within the said tax incremental district is suitable for industrial sites within .the meaning of Section 66.52 of the Wisconsin Statutes; and significantly the value of all of the other real property (b) The improvement of such area is likely to enhance in the said tax incremental district; and (c) The aggregate value of equalized taxable property of the said tax incremental district, together with that of Tax Incremental District Number One, Tax Incremental District Number Two, Tax Incremental District Number Four, Tax Incremental District Number Five, Tax Incremental District Number Six and Tax Incremental District Number Seven, does not exceed 5% of the total value of equalized taxable property within the City of Muskego, there being no more tax incremental districts in the City of Muskego. prepare a Project Plan for Tax Incremental District Number Three, pursuant to the provisions of Section 66.46 (4) (d) of the Wisconsin Statutes, and to submit the said Plan to the Common Council for its review and approval. 4. The Planning Commission is hereby authorized and directed to 5.
