C. 136-79 A RESOLUTION DESIGNATING THE PROPOSED BOUNDARIES OF TAX INCREMENTAL DISTRICT NUMBER ONE CITY OF MUSKEG0 WHEREAS, Section 66.46 of the Wisconsin Statutes (the "Tax Increment Law") provides the authority and establishes the procedures for creating tax incremental districts; and WHEREAS, the southwest portion of the City is in need of sanitary sewer and collector street extensions in order for orderly development to occur; and WHEREAS, the Planning Commission, after completing the preliminary planning work, scheduled, gave public notice of, and on September 4, 1979, held a public hearing on the creation of the proposed tax with the procedures specified in the Tax Increment Law; and incremental district and the proposed boundaries thereof, in accordance WHEREAS, prior to its publication, a copy of the notice of the Waukesha County Board of Supervisors and the District Board of the said public hearing was sent to the chief executive officers of the Waukesha County Vocational, Technical and Adult Education District within the proposed district) and the School Board of the Muskego- (the other entities having the power to levy taxes on property located Norway School District (the school board of the school district which includes property located within the proposed district), in accordance with the procedures specified in the Tax Increment Law; and WHEREAS, the Planning Commission, after due consideration follow- ing the said public hearing, determined that the creation of a tax description attached to this resolution will provide the City of incremental district within the area described by the boundary Muskego with a viable method of financing the costs of neded public opportunities for appropriate private development, including new improvements within the said area, thereby creating incentives and development and improvement of existing development, which will contribute to the overall development of the southwest portion of the City; and WHEREAS, the City's consulting engineer has reported that the total area of the proposed district is no more than570.667 acres and in Wisconsin Statutes, Section 66.46(2) (a) is no less than562.947 the total area of the proposed district that is blighted as defined acres; and Tax Increment Law, before the Common Council may create any tax WHEREAS, in accordance with the procedures specified in the incremental district, the Planning Commission must designate the boundaries of such district and submit its recommendation concerning the creation of such district to the Common Council; NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION O€ THE CITY OF MUSKEGO, as follows: .., i .? 1. That the Planning Commission hereby designates the boundaries specified in the boundary description attached to this resolution as Exhibit A hereof, and entitled "Boundary Description of Tax Incremental District Number One, City of Muskego", as the boundaries of the said Tax Incremental District Number One, and recommends that the within the area enclosed by the said boundaries. said district be created by the Common Council of the City of Muskego Common Council adopt the resolution attached to this resolution as 2. Exhibit B A RESOLUTION CREATING, DESCRIBING AND MAKING CERTAIN FINDINGS CONCERNING TAX INCREMENTAL DISTRICT .NUMBER ONE, CITY OF MUSKEG0 WHEREAS, the overall development of the southwest portion of the City of Muskego is recognized as a major need of the City; and district, in accordance with the provisions of Section 66.46 of the Wisconsin Statutes (the "Tax Increment Law"), in order to provide a within the said district and thereby create incentives and opportunities viable method of financing the costs of needed public improvements for appropriate private development, including new development and improvement of existing development, which will contribute to the overall development of the southwest portion of the City; and WHEREAS, the City of Muskego desires to create a tax incremental WHEREAS, in accordance.with the procedures specified in the Tax Increment Law, the Planning Commission, on September 4, 1979, held a public hearing concerning the proposed creation of a tax incremental district in the City of Muskego, and thereafter designated the boundaries of the proposed tax incremental district and recommended to the Common Council that it create such tax incremental district within the area enclosed by the said boundaries, as specified in the boundary description attached to this resolution as Exhibit A hereof, and entitled "Boundary Description of Tax Incremental District Number One, City of Muskego"; and WHEREAS, prior to its publication, a copy of the notice of the said public hearing was sent to the chief executive officers of the Waukesha County Board of Supervisors and the District Board of the Waukesha County Vocational, Technical and Adult Education District (the other entities having the power to levy taxes on property located within the proposed district; and the School Eoarii of the i.iuskega- Norway School District (the school board of the school district which with the procedures specified in the Tax Increment Law; includes property located within the proposed district), in accordance NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF MUSKEGO, as follows: in the City of Muskego a tax incremental district, to be kncwn as boundaries of which shall be those recommended to the Common Council "Tax Incremental District Number One, City of ~l~i;l:ssc"" , tile by the Planning Commission, as specified in the attached Exhibit A. 1. The Planning Commission is hereby authorized and directed to prepare a Project Plan for Tax Incremental District Number One, Statutes, and to submit said Plan to the Common Council for its pursuant to the provisions of Section 66.46(4) (d) of the Wisconsin review and approval.. 5. The City Clerk is hereby authorized and directed to apply to the Wisconsin Department of Revenue, in such form as may be prescribed, pursuant to the provisions of Section 66.46(5) (b) of the Wisconsin for a "Determination of Tax Incremental Base", as of January 1, 1979, Statutes. 6. The City Assessor is hereby authorized and directed to identify upo~ the assessment roll retaiild and exzmined ui;ds:r Section 70.45 of the Wisconsin Statutes, those parcels of property which are within Tax Incremental District Number One, specifying thereon the name of the said tax incremental district, and the City Clerk is hereby authorized and directed to make similar notations on pursuant to Section 66.46(5)(f) of the Wisconsin Statutes. the tax roll made under Section 70.65 of the Wisconsin Statutes, Adopted this -,,-. day of September, 1979.
