PCR1976046RESOLUTION #Pa C. 46-76 LEGAL STATUS REQUEST - DAVID BEIERLE RECOMMENDATION OF DENIAL request for legal status in August, 1975, for two lots on College Avenue owned by David Beierle, S63 W17202 College Avenue, and WHEREAS the Plan Commission and Common Council denied a WHEREAS Attorney John Couture, representing Mr. Beierle, two lots along with additional information, same- referred to submitted a second petition requesting legal status for these Planning Consultant Mangiamele by the Comm2ssiori in March, 1976, and WHEREAS Planning Consultant Mangiamele has reviewed the new information which had been submitted regarding this request and is of the opinion that this evidence would not warrant changing the original decision of the Plan Cmission to recom- mend denial for those same reasons indicated in Resolution BP. C. 67-75 adopted by the Commission July 1, 1975. THEREFORE BE IT RESOLVED that the Plan Cmission of the City of Muskego does hereby concur with the planner's recmen- request for legal status submitted by David Beierle be denied dation and does hereby recormend to the Common Council that this for €he following reasons: 1. This is an RSE District which requires 40,000 sq. ft. lots if sewer is available and double lot size if sewers are not available. 2. This area is not intqnded for sewer for several years. 3. The lot on which the existing residence is located is 34,583 sq. ft. and the lot for which legal status is requested is 24,875 sq. ft. which is considerably less than fhe lot size required if sewers were available. 4. These lots are located in a predominantly undeveloped area and to permit legal status for these substandard lots would have a tendency to set a precedent for future developments.
