T6SS CORNERS DRIVE ACCESS
WHEREAS a request to construct a dwelling on a parcel
of land with access to Tess Corners Drive has been submitted
to the Plan Commission for approval, and
WHEREAS it was noted that this parcel was created by
certified survey map in 1973 by Raymond Lakin, and
WHEREAS in 1962 at the time the certified survey map
incorporating lands south of Tess Corners Drive was approved
by the Plan Commission, there was imposed a restriction that
"there shall be no right of ingress or egress from Lots 1 and
2 to Tess Corners Road", and
WHEREAS an opinion from City Attorney Buckley daeedeffpril
'165'1976, advises that the Plan Commission could not remove that
requirement without notifying other property owners in the area
and that it would be necessary that a waiver of that restriction
be received from all owners of lands in the subdivision.
THEREFORE BE IT RESOLVED that the Plan Commission does
hereby refer this request for access to Tess Corners Drive to
Planning Consultant Mangiamele for review and recommendation.
