C. 67-75 DENIAL OF LEGAL STATUS REQUEST DAVID BEIERLE WHEREAS a petition requesting legal status for two lots on College Avenue submitted by David Beierle, S63 W17202 College Avenue, I I was referred to Planning Consultant Mangiamele at the last meeting, and WHEREAS after review, Planning Consultant Mangiamele has recommended denial for the following reasons: 1. This is an RSE District which requires 40,000 sq. ft. lots if sewer is available and double lot size if sewers are not available. 2. This area is not intended for sewer for several years. 3. The lot on which the existing residence is located is 34,583 sq. ft. and the lot for which legal status is requested is 24,875 sq. ft. which is considerably less than the lot size required if sewers were available. n a 4. These lots are located in a '!predominantly undeveloped area and to permit legal status for these substandard lots would have a tendency to set a precedent for future developments. THEREFORE BE IT RESOLVED that the Plan Commission of the City of Muskego does hereby concur with the planning consultant's recommendation and does hereby deny this request for legal status submitted by David Beierle.
