C. 36-75 APPROVAL OF BUILDING, SITE & OPERATIONAL PLANS MUSKEGO BEER DEPOT WHEREAS Lawrence Fischer, owner of Muskego Beer Depot, has requested approval of building, site and operational plans for a 20' x 63' addition to the Muskego Beer Depot, S75 W17308 Janesville Road, to be used for storage purposes, and WHEREAS the Plan Commission on the 7th day of September, 1971, granted a conditional use to Mr. Fischer which permitted him to construct five apartment units above the beer depot, and WHEREAS in order to have sufficient open space, Mr. Fischer purchased land north and adjacent to his property measuring and 125' x 167' on which there are three existing residential units, WHEREAS the proposed addition raises the question as to whether or not the residential units on the property have sufficient usable Ordinance which states in part that the required open space must be' open space as required in Section 5.07 (2) of the Muskego Zoning considered usable and "shall readily be accessible and of such a size and shape which can be reasonably considered to provide for the amenities and necessities of light, air, play space, drying yard, garden, etc...... , and 0 I' required by Section 5.07 (2) of the Zoning Ordinance one of the buil- dings should be removed and any obstruction to the use of the open space also removed. WHEREAS it would appear that to make use of the open space as THEREFORE BE IT RESOLVED that the Plan Commission of the City plans for a 20' x 63' addition to the Muskego Beer ,Depot subject of Muskego does hereby approve of the building, site and operational to the following: 1. That the single family home behind the beer depot shall be removed within two years to provide usable open space. of this open space by the residents of the duplex behind the beer depot and the five apartment units shall be removed and the area properly landscaped. 2. That any existing obstruction which would prohibit the use living in the five apartment units a ove the beer depot shall be asphalted within one year. 3. That the driveway and parkin areas used by the residents E residential parking area shall be landscaped within one year. 4.
