DEFERRAL ON REQUEST FOR LEGAL STATUS

WHEREAS a petition for determination of legal status for two
parcels of property on Racine Avenue in the SE 114 of Section 20
submitted by Carl Posbrig, W188 S9707 Parker Drive, is before the
Commission for consideration, and
WHEREAS the legality of Section 2.4 (2) of the Land Division
Ordinance is being questioned by the petitioner's legal counsel, and
WHEREAS it was the Commission's decision to consult: with City
Attorney Buckley prior to taking action on said petition, and
WHEREAS Attorney Buckley has advised that the city is presently
e involved in a suit with Waukesha County in which the validity of
Section 2.4 (2) of the Subdivision Control Ordinance is being
challanged, and
WHEREAS for this reason Attorney Buckley has advised the Commission
to defer action on the petition for legal status submitted by Carl
Posbrig until a judgment has been made on that suit.
THEREFORE BE IT RESOLVED that the Plan Commission of the City
of Muskego does hereby defer action on the request of Carl Posbrig for
determination of legal status until the legality of Section 2.4 (2)
has been determined.
