C. 66-74 APPROVAL OF SOLID, NONCOMBUSTIBLE LANDFILL OPERATION (As AMENDED) and Mr. Allen Van Dyken petitioned the city to permit a sanitary landfill operation at the corner of Tans and Hillendale Drives, and WHEREAS on the 13th day of September, 1971, Mr. Norman Thomas WHEREAS the Plan Commission held a public hearing to consider this request on November 2, 1971, and WHEW2A.5 after considerable discussion and study, the Plan Commission at their meeting October 3, 1972, recommended to the Common Council that the application for a sanitary landfill submitted by Mr. Thomas and Mr. VanDyken be denied and the Common Council con- curred with this recommendation in their Resolution #200-72 adopted October loth, 1972, and WHEREAS on October 17th, 1972, the glan Commission advised Mr. Thomas that they would be receptive to a solid landfill on this site activity proposed and that restoration be completed within two years, subject to formal application, necessary bond, description of the and WHEREAS the Plan Commission recommended to the Common Council January 2, 1973, that Mr. Thomas be granted a solid landfill permit in their Resolution #P. C. 4-73 and the Common Council concurred with the recommendation in their Resolution #3-73 As Amended adopted January 23, 1973, which included the following conditions: 1. That he also receive a permit from the Department of Natural Resources. 2. That in order to provide adequate screening and to insure the use of the premises by only authorized persons a fence acceptable to the Plan Commission shall be provided along Tans Drive. 3. That a $35,000 bond be provided to the City of Muskego. 4. That assurance be provided that proper equipment will be on the premises to insure compaction and coverage. 5. That the hours of operation of the landfill be limited to 7:30 A. M. to 5:30 P. M. 6. That no operation will take place on Sundays. Requiring the Licensing of and Regulating Landfill Disposal Sites) 7. That there is strict compliance to Ordinance #194 (An Ordinance where applicable. 8. That it is thelnderstanding of Mr. Thomas and the City of Muskego that the total restoration of the site by solid landfill method will be completed in three years. 10. That "No Trespassing" or "Danger" signs be placed on the west property line, and WHEREAS an acceptable bond in the amount of $35,000 was received by the City of Muskego in August, 1973, and WHEREAS because of the failure of Mr. Thomas to acquire the necessary permit from the Department of Natural Resources as indicated in Item 1 above, the Common Council rescinded their action in Resolution #3-73 As Amended by the adoption of Resolution 8147-73 September 11, 1973, and WHEREAS in December, 1973, the Public Welfare Committee indicated their willingness to consider a re-application by Thomas Disposal Service for a limited sanitary landfill permit, and WHEREAS March 1, 1974, Mr. Thomas petitioned the City €or a permit to deposit non-combustibles, and WHEREAS in April, 1974, the City of Muskego received notice of the approval for the Thomas landfill proposal from the Department of Natural Resources. THEREFORE BE IT RESOLVED that the Plan Commission of the City of Muskego does hereby recomend to the Common Council approval of the request of Norman Thomas for a solid, non-combustible landfill operation at the corner of Tans and Hillendale Drives. BE IT FURTHER RESOLVED that the Plan Comission recommends that the conditions placed on the landfill operation in Resolution #3-73 As Amended be included in the permit grant, and that this approval is subject to review of the init4 restoration plan.
