PCR2011050 RESOLUTION #P.C. 050-2011 APPROVAL OF AN AMENDED BUILDING SITE AND OPERATION PLAN FOR VEOLIA th LOCATED IN THE NE ¼ OF SECTION 36 (TAX KEY 2301.998 and 2301.999 / 124 St) th WHEREAS, On November 22, 2011 a submittal was received from Veolia located along 124 St in the southeast corner of Muskego (Tax Key No. 2301.998), and WHEREAS, An approval for a similar use was granted under PC 037-2011 but due to some gas processing changes, this new proposal is being brought forward, and WHEREAS, The property is zoned M-3 Landfill/Extractive and allows landfill activities by right, and WHEREAS, The 2020 Comprehensive Plan shows this property as landfill uses and the proposal is consistent with the plan, and WHEREAS, The proposal is to construct a 768 sq. ft. roof structure and electrical control room near the flare at the landfill site and to also remodel and add 597 sq. ft. onto the former Briggs and Stratton building just north of the flare, and WHEREAS, These facilities are used to house the equipment required to process and pump the methane gas generated by the landfill to the Jones Island sanitary treatment facility in Milwaukee, and WHEREAS, The smaller (768 sq. ft.) building located near the flame will consist of a CMU 12’ x 24’ building, 14’ high, with a 480 sq. ft. roofed area, and WHEREAS, The former Briggs and Stratton building will be modified, including a 597 sq. ft. addition, to house the bulk of the equipment that is needed to process/treat the gas, and WHEREAS, This existing larger building is constructed out of two types of CMU block and the addition will include the same materials, and WHEREAS, The required equipment in the larger building requires a large amount of air return and ventilation and as such, there are numerous roof top mechanicals/vents being proposed, and WHEREAS, In order to screen these features, an 80” metal railing system with galvanized perforated metal infill panels will be placed on the top of the building on the north, east, and south elevations, and WHEREAS, The perforations in these panels measure .25” x .75“, which leave 11% open area, and WHEREAS, The equipment in the structure will run 24 hours a day, 365 days a year and will be continuously monitored by one employee on site approximately ten (10) hours a day, and WHEREAS, As part of the gas treatment, there are numerous pieces of equipment will be kept outside around the larger building within two groupings, and WHEREAS, The northern grouping will contain various pieces of outdoor equipment and will be enclosed with a 10 foot high chain link fence and the fence will contain vertical cedar boards on the north, east, and south elevations and decorative slatting on the west elevation, and WHEREAS, The south/southwest grouping will contain two electrical transformers and 4 taller storage tanks in the rear and this area will also have a 10 foot high chain link fence on the east and south sides and it will contain vertical cedar boards on the two sides, and WHEREAS, The petitioner had a sounds analysis done and it is stated that the dBA level is not expected to exceed 63 dBA at the nearest lot line and as part of the landfill agreement with the City, Veolia cannot exceed 65 dBA and their proposal is within the requirement. THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended Building, th Site and Operation Plan for Veolia located along 124 St (Tax Key No. 2301.998). BE IT FURTHER RESOLVED, Approvals from the Engineering Division of grading plans are required before the issuance of building permits. BE IT FURTHER RESOLVED, That lighting details must be submitted before building permit can be issued. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspects of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
