PCR2011046 RESOLUTION #P.C. 046-2011 APPROVAL OF TWO CERTIFIED SURVEY MAPS FOR THE BORST PROPERTY LOCATED IN THE NE ¼ OF SECTION 7 (FIELD DRIVE) WHEREAS, On November 30, 2011 two Certified Survey Maps were submitted by Nancy Borst for land divisions located in the NE ¼ of Section 7 (Tax Key No. 2185.999, 2185.998, 2190.996.004, and 2190.995 / Field Drive), and WHEREAS, The City of Muskego recently approved an offer to purchase portions of the Nancy Borst lands along Field Drive and the purchase was for conservation purposes of this high environmental quality lands, and WHEREAS, As part of the purchase agreements the City requires that the lands be rezoned appropriately and that the boundaries of the new lands be properly designated, and WHEREAS, Said property is currently zoned EA – Exclusive Agricultural District requiring minimum lot sizes of 35 acres and an average minimum width of 1,275 feet, and WHEREAS, A rezoning petition is in place to rezone the proposed City of Muskego lots to CI-1 Conservation District and to rezone the proposed retained Borst lots as RCE Rural Country Estate District requiring minimum lot sizes of 120,000 square feet and an average minimum width of 250 feet, and WHEREAS, The proposed parcels meet the requirements of the petitioned rezoning and this resolution is subject to this rezoning approval per below, and WHEREAS, The “outlots” shown on the two CSMs are the general areas that the City is to be purchasing while the “lots” shown on the two CSMs are the areas to be retained by the Borst parties, and WHEREAS, The 2020 Plan depicts the area for Rural Density and Conservation Preservation uses and the proposal is consistent with the plan, and WHEREAS, Said parcels will be serviced by private water wells and private sewer systems. THEREFORE BE IT RESOLVED, That the Plan Commission approves of two Certified Survey Maps submitted Nancy Borst located in the NE ¼ of Section 7 (Tax Key No. 2185.999, 2185.998, 2190.996.004, and 2190.995 / Field Drive), subject to resolution of technical discrepancies as identified by the City Community Development Department and City Engineers, and payment of all applicable fees in Section 18.14(3) of the Land Division Ordinance and outstanding assessments if applicable. BE IT FURTHER RESOLVED, That this CSM approval is dependent on Council approval of the rezoning as submitted under Plan Commission Resolution #045-2011 or the CSM will have to be reconfigured to meet the present zoning requirements. BE IT FURTHER RESOLVED, That the 79 foot access shown for Lot 1 is allowed in order to allow appropriate setbacks for the existing house on Lot 3. BE IT FURTHER RESOLVED, That all technical corrections from the City will need to be addressed before the Certified Survey Map can be signed and recorded. BE IT FURTHER RESOLVED, That a digital file of this CSM shall be submitted to the City in accordance with Common Council Ordinance No. 1118 and Resolution 196-2002.
