PCR2011005 RESOLUTION #P.C. 005-2011 APPROVAL TO AMEND THE BUILDING, SITE AND OPERATION PLAN TO ALLOW A SEASONAL GARDEN CENTER FOR WAL-MART AT THE PROPERTY LOCATED AT W159 S6530 MOORLAND ROAD (TAX KEY NO. 2169.999.003) WHEREAS, A request for temporary outdoor garden center sales has been submitted by Store Manager Jason Radliff for the Muskego Wal-Mart located at W159 S6530 Moorland Road, and WHEREAS, The petitioner is proposing to allow the northern façade of the existing Garden Center enclosure to be used for seasonal sales of certain garden center materials, flowers, and plants, and WHEREAS, The proposed area would consist of pallets of materials along with benches for plants and flowers, and WHEREAS, The proposed area is shown to consume 13 parking stalls along this northern façade of the existing Garden Center enclosure, and WHEREAS, It is proposed that the sales and setup in this proposed area could occur from stth March 1 - September 5, 2011, and WHEREAS, The proposed area is not within the main area of the parking lot, and WHEREAS, The petitioner is requesting no signage. THEREFORE BE IT RESOLVED, That the Plan Commission approves the temporary outdoor garden center sales subject to the following conditions: st 1. Dates of operation only approved for sales and setup from March 1 - September th 5, 2011, and 2. The area must be kept in a neat and clean order at all times, and 3. Habitual complaints of litter or unsightliness resulting from the proposed outdoor garden center sales may result in Plan Commission re-review of this proposal at anytime which may result in revocation of this approval OR further contingencies, and 4. That this approval is only good for 2011 and successive outdoor sales must first receive Planning Commission approval.
