RESOLUTION #P.C. 004-2011
APPROVAL OF A BUILDING SITE AND OPERATION PLAN FOR L SPA LOCATED IN THE
SE ¼ OF SECTION 2 (JANESVILLE ROAD / TAX KEY NO. 2165.985)
WHEREAS, Plans were submitted by L Spa, LLC on January 18 2011 for a Building, Site and Operation
Plan for L Spa at the properties located in the SE ¼ of Section 2, and
WHEREAS, The petitioner is proposing to build a 3,042 square foot structure for a new full service day
spa facility, and
WHEREAS, The structure is to be built in a bungalow style theme with four-sided architecture in mind
and the architecture meets the Historic Crossroads Design Guide which the property lies within, and
WHEREAS, The materials include hardie shingle, hardie trim, hardie plank, stone sills, stone veneers,
and asphalt dimensional shingles, and
WHEREAS, The bungalow style architecture is complimented with false dormers on the roof, the faux
window shutters found around the windows, pillars, hardie shake and shingle, and the soffit struts under
the gable lines, and
WHEREAS, Standing Seam metal roofs are also found on the front two windows along the southern
façade, and
WHEREAS, The Historic Crossroads Design Guide does not call for 50% masonry product on structures
in this area, but rather a greater emphasis on the architecture theme presented, and
WHEREAS, Curbing is currently shown on the site, and
WHEREAS, The site layout meets the zoning requirements (height, setbacks, etc.) for the existing HC-1
district, and
WHEREAS, Twenty-five (25) parking stalls are shown for the building, which meets City parking
ordinances, and
WHEREAS, All parking stalls are shown to meet the 10 foot by 20 foot size requirement with the
exception of the stalls abutting the structure which are shown as 9’x18’, and
WHEREAS, The size in the 9’x18’ parking stalls are allowed by Planning Commission since not every
stall is proposed this way, the site size has many constraints, and since the smaller parking stalls may
work well in providing a quainter atmosphere on this parcel, and
WHEREAS, All driving lanes are illustrated currently at 25 feet in width or larger, and
WHEREAS, Signage is proposed as one wall sign on the western façade of the proposed structure, and
WHEREAS, The front wall sign measures approximately 32 sq ft, a size, which is allowed in the current
HC-1 zoning district (5% of façade max. and the wall façade measures at 747+ sq ft), and
WHEREAS, Lighting is not proposed at this time, and
WHEREAS, A landscape plan has not been submitted and certain landscaping requirements are required
per below, and
WHEREAS, A dumpster enclosure is shown to be constructed to the north of the building and the
enclosure is to be constructed with board on board fencing, and
WHEREAS, The site is serviced by city sewer and water, and
WHEREAS, Stormwater management is not required as the site is not installing over a half acre of
impervious surfaces, and
WHEREAS, The property is within Redevelopment District #1 and the Community Development
Authority reviewed the BSO at their January 18, 2011 meeting and found that the plans presented
followed the intentions of the Redevelopment District and the Historic Crossroads Design Guide.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Building, Site and
Operation Plan for L Spa at the property located in the SE ¼ of Section 2.
BE IT FURTHER RESOLVED, That special attention be paid to the grading plan to minimize the
water flow to the Tess Corners Creek.
BE IT FURTHER RESOLVED, That pole lights must have bases that don’t exceed 6 inches in height.
BE IT FURTHER RESOLVED, That City Forester approval of the landscape plan must be accomplished
prior to the issuance of building permits.
BE IT FURTHER RESOLVED, That a landscape plan must include foundation plantings and parking lot
perimeter plantings throughout the site and a particular area where larger plantings will need to occur is
along the northwest portion of the parking lot where car headlights may find there way into the backs of
some yards in the area.
BE IT FURTHER RESOLVED, No outdoor storage of dumpsters, pallets, supplies, materials, commercial
vehicles, equipment, and racking of any type will be allowed on this property.
BE IT FURTHER RESOLVED, That all bollards must be painted to match the colors of the principal
structure.
BE IT FURTHER RESOLVED, Any handicap signs must be incorporated into bored bollards.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and
that all aspects of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan
Commission.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall
result in the imposition of fines of $100 per day, the initiation of legal action, or both.
