PCR2010052 RESOLUTION #P.C. 052-2010 RECOMMENDATION TO COUNCIL TO REZONE A PROPERTY FROM THE RS-2 SUBURBAN RESIDENCE DISTRICT TO B-2 LOCAL SERVICE CENTER DISTRICT AND A 2020 COMPREHENSIVE PLAN AMENDMENT FOR THE PROPERTY LOCATED IN THE NW ¼ OF SECTION 4 (TAX KEY NO. 2174.991 / S63 W18603 MARTIN DRIVE) WHEREAS, On May 7, 2010 a petition for a rezoning was submitted by Mary Casey to rezone a property from the RS-2 Suburban Residence District to B-2 Local Service Center District (Tax Key No 2174.991 / S63 W18603 Martin Drive), and WHEREAS, The request also includes an amendment to the 2020 Comprehensive Plan from a medium density residential land use to a commercial land use, and WHEREAS, This property has been used for a variety of commercial uses, such as a sub shop and a liquor store, in the past, and WHEREAS, The newly proposed use is for a barber shop and the previous residential uses on the second floor would remain the same, and WHEREAS, A Public Hearing for the rezoning and 2020 Plan amendment was heard before the Common Council on June 22, 2010, and WHEREAS, There were two people that spoke at the hearing, one against the rezoning as a whole and one that was only against a tavern use on this property, and WHEREAS, The proposed B-2 district requires a minimum lot size of 20,000 SF and average lot width of 100’ per lot, and WHEREAS, The property is currently served by municipal sanitary sewer and a private water well, and WHEREAS, No specific details regarding any site/building improvements have been submitted at this time. THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend approval to the Common Council for the rezoning from RS-2 Suburban Residence District to B-2 Local Service Center District and for a 2020 Comprehensive Plan amendment from medium density residential to commercial for the identified property (Tax Key No 2174.991 / S63 W18603 Martin Drive). BE IT FURTHER RESOLVED, That depending on the nature of improvements to the building and the site, a Building, Site, and Operation Plan may need to be approved by the Plan Commission and/or staff approvals may be required before any changes occur to this property and a Business Registration form needs to be submitted to and approved by the City before the business can use the site.
