RECOMMENDATION TO COUNCIL TO REZONE THE OMAN PROPERTY FROM THE
RSE SUBURBAN ESTATE DISTRICT TO RC-3 COUNTRY RESIDENCE DISTRICT
LOCATED IN THE NW ¼ OF SECTION 3 (TAX KEY NO. 2170.999 / S63 W16495
COLLEGE AVE)
WHEREAS, On April 22, 2010 a petition for a rezoning was submitted by Paul Oman to rezone a
property from the RSE Suburban Estate District to RC-3 Country Residence District (Tax Key No
2170.999 / S63 W16495 College Ave.), and
WHEREAS, The reason for the request is because the petitioner would like to be able to split
their current lot into two lots and the proposed rezoning will make said land division possible,
where as the current zoning does not since this area is not sewered, and
WHEREAS, A Public Hearing for the rezoning was heard before the Common Council on May
25, 2010, and
WHEREAS, The proposed RC-3 district requires a minimum lot size of 40,000 SF and average
lot width of 150’ per lot, and
WHEREAS, The property is currently served by a private on-site sanitary system and a private
water well,
WHEREAS, The 2020 Comprehensive Plan identifies this area as Low Density Residential,
which does not need to be amended as part of this request.
THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend approval
to the Common Council for the rezoning from RSE Suburban Estate District to RC-3 Country
Residence District for the Oman property (Tax Key No. 2170.999/ S63 W16495 College Ave.).
BE IT FURTHER RESOLVED, The formal land division (CSM) of this property will still need
separate approvals at a later date, if said rezoning is approved.
