RECOMMENDATION TO COUNCIL TO REZONE THE THIELE PROPERTY FROM
THE RS-1 SUBURBAN RESIDENCE DISTRICT TO B-4 HIGHWAY BUSINESS
DISTRICT AND A 2020 COMPREHENSIVE PLAN AMENDMENT FOR THE
PROPERTY LOCATED IN THE SW ¼ OF SECTION 17 (TAX KEY NO. 2227.991.002 /
S83 W20342 JANESVILLE ROAD)
WHEREAS, On April 7, 2010 a petition for a rezoning was submitted by Kenneth and Dorothy
Thiele to rezone a property from the RS-1 Suburban Residence District to B-4 Highway Business
District (Tax Key No 2227.991.002 / S83 W20342 Janesville Road), and
WHEREAS, The request also includes an amendment to the 2020 Comprehensive Plan from a
medium density residential land use to a commercial land use, and
WHEREAS, The reason for the request is because the petitioner would like to be consistent with
the commercial use of the property to the west, being along a main arterial of Janesville Road,
and as the current shape of the property doesn’t best necessitate residential uses,
WHEREAS, A Public Hearing for the rezoning and 2020 Plan amendment was heard before the
Common Council on May 25, 2010, and
WHEREAS, The proposed B-4 district requires a minimum lot size of 20,000 SF and average lot
width of 100’ per lot, and
WHEREAS, The property is currently served by municipal sanitary sewer and municipal water,
and
WHEREAS, There are no specific alterations being proposed at this time relating to this request.
THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend approval
to the Common Council for the rezoning from RS-1 Suburban Residence District to B-4 Highway
Business District and for a 2020 Comprehensive Plan amendment from medium density
residential to commercial for the Thiele property (Tax Key No. 2227.991.002 / S83 W20342
Janesville Road).
BE IT FURTHER RESOLVED, That Plan Commission Building, Site, and Operation Plan
approvals would still be needed in the future if there are ever any future businesses desired for
Building, Site, and Operation Plan approvals.
