PCR2010036 TWICE AMENDED RESOLUTION #P.C. 036-2010 APPROVAL OF AN AMENDED LANDSCAPE PLAN FOR MUSKEGO TIRE AND AUTO LOCATED IN THE NW ¼ OF SECTION 10 (JANESVILLE ROAD) WHEREAS, Plans were submitted by Keith Hammitt on March 26, 2010 for an amended landscape plan for Muskego Tire and Auto located in the NW ¼ of Section 10, and WHEREAS, Muskego Tire and Auto received Plan Commission approval last summer and is open for business today, and WHEREAS, The landscape plan was approved by our City Forester, the petitioner is getting ready to install the landscaping per the plan and has come across a chance to include a windmill they would like to restore and erect on the northeast corner of the property, and WHEREAS, Plan Commission approval is required for items over 6 inches in height per zoning ordinance, and WHEREAS, The windmill formally adorned the north side of Janesville Road for decades just east of the Firestone property, and WHEREAS, The petitioner is having the windmill totally restored being powder-coated to match the exterior color scheme of the newly constructed Firestone building, and WHEREAS, The windmill is to be erected along the northeast corner of the lot just east of the current parking lot, and WHEREAS, The windmill is approximately 48 feet tall and the base of the windmill will be outlined with lilac trees and other shrubs, and WHEREAS, The first 16 feet of ladder that adorns the windmill will be removed for safety purposes, and WHEREAS, The windmill is to be fully operational (for decorative purposes, not for renewable energy purposes) and maintained in perpetuity, and WHEREAS, Muskego encourages buildings representing the community’s agricultural past (rustic structure ordinance). THEREFORE BE IT RESOLVED, That the Plan Commission approves an amended landscape plan for Muskego Tire and Auto located in the NW ¼ of Section 10. BE IT FURTHER RESOLVED, That a building permit is required for the installation of the windmill. BE IT FURTHER RESOLVED, That the windmill must be maintained in the powder-coated condition at all times and lubricated so as to not create abnormal excessive noises. BE IT FURTHER RESOLVED, That an annual review will be required for noise concerns and will expire after one year if there are no issues. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspects of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
