PCR2010035 RESOLUTION #P.C. 035-2010 RECOMMENDATION TO COUNCIL TO REZONE THE PLUMLEY PROPERTY FROM THE ERS-3 EXISTING SUBURBAN RESIDENCE DISTRICT TO DR-1 DOWNTOWN REVIVAL DISTRICT AND A 2020 COMPREHENSIVE PLAN AMENDMENT FOR THE CONTINUED COMMERCIAL USE OF A PROPERTY LOCATED IN THE SW ¼ OF SECTION 9 (TAX KEY NO. 2195.991 / S76 W18180 JANESVILLE ROAD) WHEREAS, On February 16, 2010 a petition for a rezoning was submitted by Michael Plumley to rezone a property from the ERS-3 Existing Suburban Residence District to DR-1 Downtown Revival District (Tax Key No 2195.991 / S76 W18180 Janesville Road), and WHEREAS, The request also includes an amendment to the 2020 Comprehensive Plan from a medium density residential land use to a commercial land use, and WHEREAS, The reason for the request is because the petitioner would like to bring their existing business use into a legal and conforming use, and WHEREAS, A Public Hearing for the rezoning and 2020 Plan amendment was heard before the Common Council on March 23, 2010 and the petitioner’s son-in-law spoke in favor of this request, and WHEREAS, There was a phone call received by the Mayor noting a concern of other possible commercial uses being allowed, and WHEREAS, The proposed DR-1 district requires a minimum lot size of 7,200 SF and average lot width of 60’ per lot, and WHEREAS, The property is currently served by municipal sanitary sewer and municipal water, and WHEREAS, There are no specific alterations being proposed at this time relating to this request. THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend approval to the Common Council for the rezoning from ERS-3 Existing Suburban Residence District to DR-1 Downtown Revival District and for a 2020 Comprehensive Plan amendment from medium density residential to commercial for the Plumley property (Tax Key No. 2195.991 / S76 W18180 Janesville Road). BE IT FURTHER RESOLVED, That Plan Commission and/or staff approvals will be required in the future for any site, building, or signage modifications.
