PCR2010007 RESOLUTION #P.C. 007-2010 RECOMMENDATION TO COMMON COUNCIL TO REZONE A PROPERTY FROM EA (EXCLUSIVE AGRICULTURAL) TO A-1 (AGRICULTURAL) AND APPROVAL OF A CERTIFIED SURVEY MAP FOR THE HAITA PROPERTY LOCATED IN THE NE ¼ OF SECTION 30 (TAX KEY NOS. 2277.996.003 & 2277.996.004 / S98 W21184 PARKER DRIVE & ADJOINING VACANT LOT TO THE EAST) WHEREAS, On November 18, 2009 a petition to rezone a property from the EA – Exclusive Agricultural District to A-1 Agricultural District and a Certified Survey Map for a two (2) lot land division was submitted by Avid & Linda Haita (Tax Key Nos. 2277.996.004 & 2277.996.003 / S98 W21184 Parker Drive & vacant lot to the east), and WHEREAS, The reason for the rezoning request is because the petitioner has a pending land division that is dependent upon the rezoning approval, and WHEREAS, The two parcels vary is size from 7.54 acres to 8.29 acres, and WHEREAS, A Public Hearing for the rezoning is scheduled before the Common Council per code, and WHEREAS, The current zoning of EA requires a minimum lot size of 35 acres and average lot width of 1275 feet per lot and the proposed rezoning of A-1 requires a minimum lot size of 120,000 square feet and average lot width of 300 feet per lot, and WHEREAS, The properties will be/are served by private onsite sewer systems and a private water wells, and WHEREAS, The 2020 Comprehensive Plan depicts the property for Rural Density Residential uses and said rezoning is consistent with the plan. THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend approval to the Common Council for the rezoning from EA-Exclusive Agricultural District to A-1 Agricultural District and a Certified Survey Map for a two (2) lot land division (Tax Key Nos. 2277.996.004 & 2277.996.003 / S98 W21184 Parker Drive & vacant lot to the east), subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14(3) of the Land Division Ordinance and outstanding assessments if applicable. BE IT FURTHER RESOLVED, That all technical corrections from the City will need to be addressed before the Certified Survey Map can be signed and recorded. BE IT FURTHER RESOLVED, That a digital file of this CSM shall be submitted to the City in accordance with Common Council Ordinance No. 1118 and Resolution 196-2002.
