APPROVAL OF AN ACCESSORY STRUCTURE (CARPORT) FOR THE SKARDA PROPERTY
LOCATED IN THE NE ¼ OF SECTION 5
(TAX KEY NO. 2177.940.004 / W188 S6539 GOLD DRIVE)
WHEREAS, On September 21, 2009 a site plan, a narrative, and photos were submitted by Donald Skarda
to construct an accessory structure (miscellaneous screening device/carport) for the property located at
W188 S6539 Gold Drive (2177.940.004), and
WHEREAS, The property is zoned RS-2, Suburban Residence District, and where said accessory structure
is a permitted accessory use and subject to Plan Commission review due to the requirements of the General
Design Guide regarding miscellaneous screening devices, and
WHEREAS, The proposed accessory structure (miscellaneous screen device/carport) will be 12’ x 29’ in
size, totaling 348 square feet, which will be used to house an RV, and
WHEREAS, Currently on the parcel is a house, an existing shed (96 square feet), and a new separately
approved 20’ x 20’ detached garage (400 square feet), and
WHEREAS, The total square footage allowed for accessory structures on this property is limited to 1,290
square feet, and said proposal (844 square feet total) meets the bulk requirements of the Zoning Code, and
WHEREAS, The carport will be about 140 feet away from the front lot line and 5 - 5.5 feet away from the
north side lot line, and
WHEREAS, Since they are proposing to be allowed to be 5 - 5.5 feet from the northern side lot line, rather
than the typically required 15 feet, they are also asking the Plan Commission for this waiver, which is
allowed by code, and
WHEREAS, The neighbor has signed off on this waiver being granted, and
WHEREAS, Since this is the second structure over 120 square feet in size on this property and due to the
metal materials, Plan Commission must also approve the structure for said reasons, and
WHEREAS, The structure is a car port type structure constructed with metal support poles, a slate
(blueish/gray) metal roof, and open sides, and
WHEREAS, The petitioner has stated that the proposed color with match the color of the house, and
WHEREAS, The proposed location of this new building will be located in an area that is wooded and will be
barely seen and the owner has planted 6 additional 6’ tall evergreens to help screen this further from their
neighbor’s property.
THEREFORE BE IT RESOLVED, That the Plan Commission approves an accessory structure
(miscellaneous screen device/carport), 348 square feet in area, submitted by Donald Skarda for a property
located at W188 S6539 Gold Drive (2177.940.004).
BE IT FURTHER RESOLVED, That the color of the new structure must match the color of the house on this
property.
BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site
plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
