RECOMMENDATION TO COUNCIL TO REZONE THE PODZIEMSKI PROPERTY FROM THE
RSE SUBURBAN ESTATE DISTRICT TO B-3 GENERAL BUSINESS DISTRICT FOR A
FUTURE BEAUTY SALON LOCATED IN THE SE ¼ OF SECTION 25
(TAX KEY NO. 2259.995.004 / LOOMIS DRIVE)
WHEREAS, On August 21, 2009 a petition for rezoning was submitted by John Podziemski to
rezone a property from the RSE Suburban Estate District to B-3 General Business District (Tax
Key No 2259.995.004 / Loomis Drive), and
WHEREAS, The reason for the rezoning request is because the petitioner is proposing to open a
hair salon on this property pending this rezoning approval, and
WHEREAS, A Public Hearing for the rezoning was heard before the Common Council on
September 22, 2009 and the petitioner spoke in favor of this request, and
WHEREAS, A letter was submitted from a property owner behind this property that is not in favor
of any commercial uses in this area, and
WHEREAS, The proposed B-3 district requires a minimum lot size of 20,000 SF and average lot
width of 100’ per lot, and
WHEREAS, The property will be served by municipal sanitary sewer and a private water well,
and
WHEREAS, The 2020 Comprehensive Plan depicts the property for Commercial uses and said
rezoning is consistent with the plan, and
WHEREAS, A conceptual site plan and building elevation have been submitted to show the
potential development/layout of this site.
THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend approval
to the Common Council for the rezoning from the RSE Suburban Estate District to B-3 General
Business District for the Podziemski property (Tax Key No. 2259.995.004 / Loomis Drive).
BE IT FURTHER RESOLVED, That Plan Commission approval will be required in the future for
formal Building, Site, and Operation Plan (BSO) approval and the rezoning ordinance is
dependent on this future BSO approval.
