PCR2009057 RESOLUTION #P.C. 057-2009 APPROVAL OF AN ADDITIONAL ACCESSORY STRUCTURE FOR THE ANDERSON PROPERTY LOCATED IN THE NW ¼ & NE ¼ OF SECTION 12 (TAX KEY NO. 2206.999.002 / S71 W13203 TES CORNERS DRIVE) WHEREAS, On August 7, 2009 a site plan and building drawings were submitted to relocate a 1,700 square foot accessory structure (50’ x 34’) on to the property located at S71 W13203 Tess Corners Drive, and WHEREAS, The property is zoned RS-2 Suburban Residence District, and whereas said structure is a permitted accessory use and subject to Plan Commission review due to more than one accessory structure on the lot as per design guidelines for residential uses, and WHEREAS, Four accessory structure totaling 7,008 square feet and a home residence currently reside on the property, and WHEREAS, The total square footage for accessory structures on this property is limited to about 61,000 square feet, and said proposal meets the bulk requirements of the Zoning Code, and WHEREAS, The combined total of the five (5) accessory structures will be 8,708 square feet, which is within the allowed limit, and WHEREAS, The structure is proposed to be constructed with residential siding and a shingled roof and said proposal does meet the Plan Commission’s standards for administrative approval of residential accessory structures as the siding and roof materials are of a residential quality and will be similar colors to the existing house on the property, and WHEREAS, The proposed height is 13 feet, as measured by code, and WHEREAS, This is an existing building that is being relocated here from a neighboring property. THEREFORE BE IT RESOLVED, That the Plan Commission approves a 1,700 square foot accessory structure submitted by Steve Anderson for a property located at S71 W13203 Tess Corners Drive. BE IT FURTHER RESOLVED, That the colors of the proposed building must match the colors of the existing home. BE IT FURTHER RESOLVED, That the floor of the entire building must be concrete. BE IT FURTHER RESOLVED, That the building cannot be used for the operations of any business activities. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
