APPROVAL OF A BUILDING SITE AND OPERATION PLAN AMENDMENT FOR ST. PAUL’S
LUTHERAN CHURCH LOCATED IN THE NE ¼ AND THE SE ¼ OF SECTION 2 (S66 W14325
JANESVILLE ROAD / TAX KEY NO. 2165.972)
WHEREAS, On July 20, 2009 a submittal was received for St. Paul’s Lutheran Church located at
S66 W14325 Janesville Road (Tax Key No. 2165.972), and
WHEREAS, The petitioner requests approvals to construct a 16,947 addition on to the St. Paul’s
Lutheran Church school building and make some site changes according to the Historic
Crossroads design guide principles, and
WHEREAS, The proposed addition will house a new gym, locker rooms, bathrooms, utilities, a
lobby/foyer, classrooms, and other miscellaneous rooms, and
WHEREAS, This addition is the first of multiple phases of long-term goals of the church, and
WHEREAS, All sides of the addition include masonry products and fiber-cement siding and
panels, brick, aluminum flashing and trim, and
WHEREAS, The roof areas are a combination of flat roofs and pitched roofs with dimensional
asphalt shingles, and
WHEREAS, The building meets the 50% masonry requirement on each façade as follows: North
(main) elevation 86%; Northwest elevation 50%; Northeast (temporary) elevation 46%; Southeast
elevation 64%; South elevation 89%, and
WHEREAS, Colors match the existing structure while now making the overall building more
unified with more consistent coloring and architectural materials, and
WHEREAS, The property is within the Historic Crossroads Deign Guide area and is also
governed by the General Design Guide and the building and site improvements follow the bulk
guidelines identified by the Design Guides, and
WHEREAS, Appropriate access is found throughout the site with multiple shared entrances,
appropriate markings, and appropriate access lane widths, and
WHEREAS, The existing church parking lot is going to be milled and replaced in the same
location as previously existed, with the previous parking stall sizes of 9’ x 18’, and
WHEREAS, The new parking areas and driveways are going to meet all current code
requirements relating to size and the placement of landscape islands, and
WHEREAS, The submittal shows a total of 183 parking stalls, which meets the City of Muskego
ordinance for parking per below:
Church Service Use: (475 occupants) = 158 spaces (1 space for every 3 seats of
church occupancy)
OR (only one use will occur at a time)
Elementary School with Auditorium Use: (872 maximum occupancy) = 175
spaces (1 space for every 5 students of maximum occupancy), and
WHEREAS, The petitioner has stated that full church use and full gym use will not occur at one
time as the gym events are planned around the church services/activities, and
WHEREAS, Curbing is proposed in most of the new areas of the site (excluding the service
drives, residential driveways, and the church parking lot), and
WHEREAS, Curbing needs to be added to the eastern side of the main entry drive where there is
not currently paving, since this is a new area, and
WHEREAS, The proposal follows the uses found in the 2020 Plan and follows the I-1
Government, Institutional, and Public Service District zoning existing on this property, and
WHEREAS, There is one zoning code variance item that the petitioners are requesting which is a
waiver from the 30 foot height limit, and
WHEREAS, The church is proposing to be allowed a height of 34 feet (as measured by code) for
their gym space in order to meet their design requirements, which will require a 4 foot variance,
and
WHEREAS, The Zoning Board of Appeals will need to decide whether or not such variance is to
be granted, and
WHEREAS, A proposed landscape plan is part of the submittal and is under review by the City
Forester, and
WHEREAS, A lighting and photometric plan is found in the submittal with the new lighting being
high pressure sodium pole lights and wall mounted wall pack lights, and
WHEREAS, The proposed lights appears to meet the City’s design guide requirements of 0.5
foot-candles at the property lines and the pole lights are historic looking in design and should fit
well within this Historic Crossroads design area, and
WHEREAS, Two new refuse enclosures are being proposed on the property, and
WHEREAS, There are roof top mechanicals that are being proposed to be screened with a wood
lattice placed over a plywood backer board and then painted a neutral colors, as was done on
Bushy’s Pub and Grill, and
WHEREAS, The site is serviced by public water and sewer, and
WHEREAS, A public water main extension is required as part of this project and as part of that a
water main easement needs to be established and a Developers Agreement needs to be setup,
and
WHEREAS, The BSO petition is within the Redevelopment District #1, which promotes the usage
of the Historic Crossroads Design Guide for new improvements.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Building, Site and
Operation Plan for St. Paul’s Lutheran Church located at S66 W14325 Janesville Road (Tax Key
No. 2165.972).
BE IT FURTHER RESOLVED, The landscape plan is subject to final City Forester approval
before the release of building permits.
BE IT FURTHER RESOLVED, That the Plan Commission is receptive to the Zoning Board of
Appeals granting of a 4 foot height variance due to the location of the building from lot lines, the
HC-1 height requirement in the surrounding area of 35 feet, and the “decorative nature” of the
pitched roof and window.
BE IT FURTHER RESOLVED, That the 100 year floodplain (field delineated, not to be taken from
a map) needs to be shown on all site drawings and not construction or grading can occur within a
floodplain area.
BE IT FURTHER RESOLVED, That curbing needs to be added to the eastern side of the main
entry drive where there is not currently paving since this is a new area (see diagram in
supplement).
BE IT FURTHER RESOLVED, That all engineering related plans including the grading, sewer,
water, and stormwater plans are subject to City Engineer approval before the issuance of any
building permits.
BE IT FURTHER RESOLVED, A water main easement needs to be established and a
Developers Agreement and Letter of Credit needs to be setup relating to the installation of the
public water main.
BE IT FURTHER RESOLVED, Any proposed signage will require formal permits from the
Planning and Building Divisions.
BE IT FURTHER RESOLVED, That the poles and fixtures cannot exceed 15 feet above grade
and the concrete bases for the poles cannot exceed 6-inch in height above grade.
BE IT FURTHER RESOLVED, That detailed light spec drawing with detailed dimensions will
need to be submitted before building permits can be issued to make sure these
height/dimensions are being met.
BE IT FURTHER RESOLVED, That all roof top and ground mechanicals (including HVAC
devices, electrical transformers, etc.) shall be screened from view and/or incorporated into the
design of the site/structure (screening, etc.) and should be approved by the Planning Division.
BE IT FURTHER RESOLVED, That all approved mechanical screening devices must completely
cover the view of all mechanicals.
BE IT FURTHER RESOLVED, That the Fire Department has to formally review and approve the
plans before building permits can be issued.
BE IT FURTHER RESOLVED, That any bollards must be painted to match the colors of the
principal structure.
BE IT FURTHER RESOLVED, That all handicap signs be incorporated into bored bollards.
BE IT FURTHER RESOLVED, That no outdoor storage of any type is allowed on the site
including, but not limited to, dumpsters, pallets, supplies, materials, and racking.
BE IT FURTHER RESOLVED, That any future buildings and/or site improvements would need a
future BSO approval to ensure the Historic Crossroads Design Guide principles are being met
along with the appropriate parking, landscaping, and stormwater requirements.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building
Department and that all aspects of this plan shall be maintained in perpetuity unless otherwise
authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this
resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or
both.
