APPROVAL OF A BUILDING SITE AND OPERATION PLAN AMENDMENT FOR
BURBACK BUILDERS LOCATED IN THE NW ¼ OF SECTION 16
(W185 S8095 RACINE AVENUE / TAX KEY NO. 2221.016.001)
WHEREAS, On June 22, 2009 a submittal was received for Burback Builders located at W185
S8095 Racine Avenue (Tax Key No. 2221.016.001), and
WHEREAS, The proposal is to place a play set in front of their building for display purposes, and
WHEREAS, The intention is to have the play set serve as an advertisement for this new product
that Burback Builders is offering for sale and installation, and
WHEREAS, There will be a sign on the play set that says, “Build for you”, and
WHEREAS, The play set area will measure about 20’ x 30’, and
WHEREAS, The play set is proposed to be located approximately 21 feet from the front lot line
along Racine Avenue, and
WHEREAS, No other site changes are proposed at this time.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Building, Site and
Operation Plan amendment submitted by Burback Builders for the placement of a play set at
W185 S8095 Racine Avenue (Tax Key No. 2221.016.001).
BE IT FURTHER RESOLVED, That no signage, other than the one sign noted above, is allowed
on or around this play set.
BE IT FURTHER RESOLVED, That no other site changes are approved at this time and any
further changes/additions will require Plan Commission approval.
BE IT FURTHER RESOLVED, That the play set must remain in good condition and if the play set
starts to look distressed, planning staff can require the repair, improvement, or removal of the
play set.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building
Department and that all aspects of this plan shall be maintained in perpetuity unless otherwise
authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this
resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or
both.
