APPROVAL OF A BUILDING SITE AND OPERATION PLAN AMENDEMNT
FOR ATONEMENT LUTHERAN CHURCH LOCATED IN THE SE ¼ OF SECTION 3
(S70 W16244 MARTIN DRIVE / TAX KEY NO. 2172.095)
WHEREAS, On June 22, 2009 plans were submitted by Frank Waltz for a Building, Site and Operation
Plan Amendment for Atonement Lutheran Church located in the SE ¼ of Section 3 (Tax Key No.
2172.095 / S70 W16244 Martin Drive), and
WHEREAS, Said property is currently zoned I-1 Government, Institutional, and Public Service District
and said use is a permitted use, and
WHEREAS, Said property is subject to the design standards outlined in the City of Muskego’s General
Design Guide, and
WHEREAS, The current church and site layout were approved through the original BSO on July 17, 2007
under PC 079-2007, and
WHEREAS, Within those proposed plans and within the approved resolution it was noted that there were
possible future parking areas shown that would require separate approval before they would be installed,
and
WHEREAS, Now the petitioner is requesting the first parking lot expansion off the east side of the entry
driveway, and
WHEREAS, The current parking lot contains about 120 spaces and the new proposal will add about 50
additional spaces, bringing the total number of stalls to about 170, and
WHEREAS, Due to the larger than expected attendance, the additional parking is now required, and
WHEREAS, The new parking lot is shown with curbing throughout most of the additional area, except
where there is still further expansion possibilities, and all parking stalls are shown as 10 feet by 20 feet in
size, and
WHEREAS, A photometric plan and parking lot lighting specifics have been submitted as part of the
BSO amendment and the plans appear to meet code requirements, and
WHEREAS, The pole lights are shown at 20 feet in height, which is allowed, as the structure is greater
than 20 feet in height, and
WHEREAS, The concrete bases of the pole lights are shown as 6 inches above grade and the bulbs are
shown to be high pressure sodium, and
WHEREAS, The two new proposed lights are stated to match the existing pole lights on site, and
WHEREAS, The Zoning Code and General Design Guide require that the concrete bases not exceed six
(6) inches above grade, and
WHEREAS, The Zoning Code and General Design Guide require that all lighting fixtures be high-
pressure sodium and the Planning Commission has usually only allowed metal halide when the lighting is
used as an architectural feature to enhance architectural elements of the building, and
WHEREAS, Landscape islands will be planted to match the existing landscape islands, and
WHEREAS, Stormwater will be utilized within an existing pond on site, and
WHEREAS, There are a few items that still need to be addressed from the original construction as
follows:
All areas of exposed or eroded dirt must be stabilized. Specifically the front area near Martin
Drive and the two large washout areas to the rear of the building.
The fire hydrant must be adjusted to an appropriate height. When the bike path was installed the
elevation and grading were filled in around the hydrant.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Building, Site and
Operation Plan Amendment submitted May 23by Frank Waltz for Atonement Lutheran Church located in
the SE ¼ of Section 3.
BE IT FURTHER RESOLVED, That the light pole bases must be six (6) inches above grade or less in
height, the fixtures must be high-pressure sodium, and the poles and fixtures must match the existing.
BE IT FURTHER RESOLVED, That any additional parking lot expansion areas and any possible building
expansion areas, which will require a separate BSO amendment through the Planning Commission at a
later date.
BE IT FURTHER RESOLVED, That an Erosion and Land Disturbance Permit will be required before any
work on the new parking lot can begin.
BE IT FURTHER RESOLVED, That a formal inspection must be requested to the Community
Development Department before the parking lot can be used so that the City can ensure that all of the
previous conditions noted above and all new conditions are met and satisfactorily completed.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Community Development
Department and that all aspects of this plan shall be maintained in perpetuity unless otherwise authorized
by the Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall
result in the imposition of fines of $100 per day, the initiation of legal action, or both.
