PCR2009046 RESOLUTION #P.C. 046-2009 RECOMMENDATION TO COUNCIL TO REZONE THE LARSON PROPERTY FROM THE RSE SUBURBAN ESTATE DISTRICT TO RS-1 SUBURBAN RESIDENCE DISTRICT FOR A LAND DIVISION LOCATED IN THE SE ¼ OF SECTION 13 (TAX KEY NO. 2212.999.002 / W125 S8330 NORTH CAPE ROAD) WHEREAS, On May 18, 2009 a petition for rezoning was submitted by Melanie Larson to rezone a property from the RSE Suburban Estate District to RS-1 Suburban Residence District (Tax Key No. 2212.999.002 / W125 S8330 North Cape Road), and WHEREAS, The reason for the rezoning request is because the petitioner has a pending land division that is dependent upon the rezoning approval, and WHEREAS, A Public Hearing for the rezoning was heard before the Common Council on June 23, 2009 and there were no comments received at the meeting, and WHEREAS, The current zoning of RSE requires a minimum lot size of 40,000 SF and average lot width of 150’ per lot and the proposed rezoning of RS-1 requires a minimum lot size of 30,000 SF and average lot width of 120’ per lot, and WHEREAS, The formal land divisions on this property will require the approval of a Certified Survey Map (CSM) by the Plan Commission and Common Council, and WHEREAS, The property is currently served by municipal sanitary sewer and a private water well, and WHEREAS, The 2020 Comprehensive Plan depicts the property for Medium Density Residential uses and said rezoning is consistent with the plan. THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend approval to the Common Council for the rezoning from the RSE Suburban Estate District to RS-1 Suburban Residence District for the Larson property (Tax Key No. 2212.999.002 / W125 S8330 North Cape Road).
