APPROVAL OF A HOBBY KENNEL FOR ROBERTA CONNOR
LOCATED IN THE NE ¼ OF SECTION 14
(TAX KEY NO. 2213.984.001 / W144 S7931 DURHAM DRIVE)
WHEREAS, A request was submitted by Roberta Connor to be allowed a Hobby Kennel on the
property that she leases located at W144 S7931 Durham Drive (Tax Key No. 2213.984.001), and
WHEREAS, The property is zoned RS-2, Suburban Residence District and said Hobby Kennel is
a permitted accessory use and subject to Plan Commission review, and
WHEREAS, The petitioner has stated that she owns 4 adult Afghan Hounds, 4 six month old
puppies, and 1 adult Shih Tzu, totaling 9 dogs, and
WHEREAS, The property in question is 7.82 acres in size, which allows 7 dogs in addition to the
2 that are already allowed by right, per the Hobby Kennel regulations, and
WHEREAS, A total of 9 dogs are allowed based upon the lot size and the proposal meets said
requirement, and
WHEREAS, The neighboring properties within 100 feet of this lot have been notified of this
petition per the code requirements, and
WHEREAS, The petitioner has stated that the kennel is only for her personal pets and show
dogs, not for commercial boarding, and
WHEREAS, There is a 5-foot high fence around an outdoor area for the dogs.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Hobby Kennel
submitted by Roberta Connor for the property that she leases located at W144 S7931 Durham
Drive (Tax Key No. 2213.984.001).
BE IT FURTHER RESOLVED, That no commercial boarding is allowed on this property.
BE IT FURTHER RESOLVED, That no more than nine (9) dogs are allowed to be kept at this
property, per the Hobby Kennel regulations.
BE IT FURTHER RESOLVED, That an annual review is required IN THE MONTH OF March
each year until the Plan Commission deems the review unnecessary.
BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the
approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation
of legal action, or both.
