PCR2009037 RESOLUTION #P.C. 037-2009 APPROVAL OF A BUILDING SITE AND OPERATION PLAN AND A CONDITIONAL USE GRANT FOR THE SALES OF POWERSPORT EQUIPMENT FOR ADRENALINE POWERSPORTS LLC AT A PROPERTY LOCATED IN THE SW ¼ OF SECTION 16 (W184 S8400 CHALLENGER DRIVE / TAX KEY NO. 2223.994.009) WHEREAS, Plans were submitted by Jean Ringer on March 31, 2009 for a Building, Site and Operation Plan and Conditional Use Grant for Adrenaline Powersports LLC in the Muskego Industrial Park at the property located in the SW ¼ of Section 16, and WHEREAS, The petitioner is proposing to fill a 12,074 square foot vacancy in an existing multi tenant building located along Racine Avenue, and WHEREAS, The petitioner is proposing to move the existing store for more space to sell new and used powersport equipment (snowmobiles, atvs, motorcycles, and personal watercraft), board sports equipment (skateboards, snowboards, wakeboards, etc.), and accessories, and WHEREAS, Said property is currently zoned M-2 General Industrial Park District and said use is a permitted use by Conditional Use Grant, and a public hearing has been scheduled before the Plan Commission on May 5, 2009, and WHEREAS, The proposal conforms to the bulk requirements of the zoning district, and WHEREAS, Said parcel will be serviced by municipal sanitary sewer and municipal water, and WHEREAS, The petitioner would like to be allowed to have an outdoor storage area in front of their store that would be placed within the grassy area between the parking lot and the roadway on private property, not the right-of-way, and WHEREAS, The display area is proposed to be an 8’ x 16’ stamped concrete slab that would be dyed to look like slate that would contain no more than two (2) units parked on the slab at any one time and displays would only be out during business hours, and WHEREAS, The petitioner will also have some outdoor storage, but will contain any storage behind a proposed cedar privacy fence, and WHEREAS, Adrenaline is currently operating out of S83 W18410 Saturn Drive for which they received a CUG for from Planning Commission back in Oct. 2008 and the same operations are proposed at this location, and WHEREAS, There will be one (1) full time employee and two (2) part time employees and they’re expecting roughly 20 to 30 customers per day, and WHEREAS, The hours of the store are proposed to be Monday – Friday from 11:00 AM until 8:00 PM, Saturday from 10:00 AM until 8:00 PM, and Sunday from 11:00 AM until 4:00 PM, and WHEREAS, No new signage is proposed at this time. THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Building, Site and Operation Plan and Conditional Use Grant for Adrenaline Powersports LLC in the Muskego Industrial Park at the property located in the SW ¼ of Section 16. BE IT FURTHER RESOLVED, No outdoor storage is allowed on site, except as allowed in the fenced area. BE IT FURTHER RESOLVED, That the outdoor display area be limited to no more than two (2) pieces of equipment at any one time and all display/storage can only be out during operational business hours. BE IT FURTHER RESOLVED, That any changes to the operations of the business or any changes to the exterior of the building/site will require Planning Department and/or Plan Commission approvals. BE IT FURTHER RESOLVED, Signage is not proposed at this time, but future signage (temporary or permanent) must be approved by the Community Development Department. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspects of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
