PCR2009031 RESOLUTION #P.C. 031-2009 RECOMMENDATION TO COMMON COUNCIL FOR AN AMENDMENT TO PD-47 - BELLE CHASSE PLANNED DEVELOPMENT DISTRICT LOCATED IN THE SW ¼ & THE SE ¼ OF SECTION 11 (BELLE CHASSE SUBDIVISION) WHEREAS, On February 26, 2009 a petition for an amendment to the existing Belle Chasse Planned Development District (PD-47) was submitted by Bill Carity for the Belle Chasse Subdivision located in the SW ¼ and the SE ¼ of Section 11 (Tax Key Nos. 2204.067-.114), and WHEREAS, The petitioner is applying to amend the existing Belle Chasse Planned Development District (PD-47) to allow reduced setbacks and offsets for all lots within the development, and WHEREAS, This planned development district was approved under the guidelines of the RS-2 zoning district, and WHEREAS, The approved planned development was allowed to have reduced lot sizes, but it was not allowed to have reduced setbacks or offsets, with the exception of corner lots allowed to have one of the street setbacks at 30’, and WHEREAS, The current planned development zoning allows the following setbacks and offsets:  Front: 40’ (40’ and 30’ for corner lots)  1 Side: 15’  Other Side and Rear: 20’, and WHEREAS, The newly proposed setbacks and offsets are as follows:  Front: 35’ (35’ and 30’ for corner lots)  1 Side: 10’  Other Side and Rear: 15’, and WHEREAS, The developer originally wanted reduced setbacks and offsets but this topic was discussed in detail at the original rezoning meetings and the Plan Commission made it clear that they did not want to allow reduced setbacks and offsets for this development based upon public comment and their discussions, and WHEREAS, The petitioner’s narrative states that the current setbacks and offsets are limiting their ability to sell lots in this current market, and WHEREAS, A Public Hearing was held on March 24, 2009 and four residents spoke against this request and Alderman Dan Pavelko spoke on the behalf of a constituent who did not support the amendment. THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the Common Council for the reduction to the required setbacks and offsets for the Belle Chasse Planned Development District located in the SW ¼ and the SE ¼ of Section 11 (Tax Key Nos. 2204.067-.114).
