APPROVAL OF AN ANNUAL REVIEW FOR THE WREFORD PROPERTY FOR A RUSTIC
STRUCTURE AT THE PROPERTY LOCATED AT W135 S8266 DURHAM DRIVE (TAX KEY NO.
2210.989.001)
WHEREAS, The Plan Commission approved a rustic structure Conditional Use Grant for the Wreford
property barn at the property located at W135 S8266 Durham Drive on January 4, 2005, and
WHEREAS, Conditions of approval included the following:
1. That a rustic structure designation be allowed for the property as long as an annual review is
held by the City’s Planning Commission and Conservation Commission yearly and that the
annual review is to make certain the barn stays in good repair, and
WHEREAS, A Planning Department February 16, 2009 site inspection showed the barn to be in
compliance with past concerns and requirements, and
WHEREAS, There were required items that needed to be addressed from 2007 that were taken care for
the 2008 annual review, and
WHEREAS, The structure was not sent to the Conservation Commission this year because past issues
have been resolved and the structure was in compliance at this time, and
THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Annual Review of the
Wreford property barn as a rustic structure at the property located at W135 S8266 Durham Drive.
BE IT FURTHER RESOLVED, That the yearly review by Plan Commission be stopped and to
transfer rustic structure authority to the Conservation Commission. be held no later than the
second meeting in March of every calendar year.
BE IT FURTHER RESOLVED, That failure to comply with the conditions of this Building, Site and
Operation Plan shall result in the imposition of fines of $100 per day per violation, the initiation of legal
action, or both.
