APPROVAL OF A FOUR LOT CERTIFIED SURVEY MAP FOR THE WERNETTE PROPERTY
LOCATED IN THE NE ¼ OF SECTION 12 AND THE SE ¼ OF SECTION 1
(TAX KEY NO. 2205.041 / W128 S7110 FLINTLOCK TRAIL)
WHEREAS, On October 27, 2009 a revised Certified Survey Map was submitted by Thomas Wernette for a four
(4) lot land division located in the NE ¼ of Section 12 and the SE ¼ of Section 1 (Tax Key No. 2205.041 / W128
S7110 Flintlock Trail), and
WHEREAS, The four parcels vary in size from 20,667 square feet to 25,268 square feet, and
WHEREAS, Said property is currently zoned RS-2 – Suburban Residence District requiring minimum lot size of
20,000 square feet and an average minimum width of 110 feet and the parcels meet said minimum zoning
requirements, and
WHEREAS, The 2020 Plan depicts the area for Medium Density Residential uses and the proposal is consistent
with the plan, and
WHEREAS, Said parcels will be serviced by municipal sewer (force main with grinder pumps) and private well
water, and
WHEREAS, The City’s aerial photography appears to show a shed on this property and accessory structures are
not allowed to remain on vacant lots.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Certified Survey Map submitted by
Thomas Wernette for a four (4) lot land division located in the NE ¼ of Section 12 and the SE ¼ of Section 1 (Tax
Key No. 2205.041 / W128 S7110 Flintlock Trail), subject to resolution of technical discrepancies as identified by
the City Planning Division and City Engineers, and payment of all applicable fees in Section 18.14(3) of the Land
Division Ordinance and outstanding assessments if applicable.
BE IT FURTHER RESOLVED, That the 15-foot wetland protection offset must also be shown along all wetland
boundaries on this CSM, including on Lot 1 and within any other setback, offset, and/or easement areas.
BE IT FURTHER RESOLVED, That proof (documentation) needs to be provided to the city to show that the force
main easement was previously granted/dedicated to the City of Muskego and if no proof exists or if it was not
formally dedicated to the City of Muskego, then this CSM needs to call out such dedication of the force main
easement to the City of Muskego.
BE IT FURTHER RESOLVED, That the exact boundary lines of the OHWM along both banks of the stream need
to be shown on the CSM.
BE IT FURTHER RESOLVED, That if the shed on this lot has already been removed, then a letter stating such
needs to be submitted and if the shed still exists, it must be shown on the CSM and there must be a note placed on
the CSM stating that all accessory structures on Lot __ (insert exact lot number) must be removed within six
months of the recording of the CSM if a house is not built on the lot by that time.
BE IT FURTHER RESOLVED, That all technical corrections from the City will need to be addressed before the
Certified Survey Map can be signed and recorded.
BE IT FURTHER RESOLVED, That a digital file of this CSM shall be submitted to the City in accordance with
Common Council Ordinance No. 1118 and Resolution 196-2002.
