PCR2009002 AMENDED RESOLUTION #P.C. 002-2009 APPROVAL OF THE SALE OF A PORTION OF CITY PROPERTY AT S75 W13950 BLUHM DRIVE TO THE BRAD MAY PROPERTY AT S75 W13880 BLUHM COURT LOCATED IN THE SW ¼ OF SECTION 12 WHEREAS, Brad May, the property owner of S75 W13880 Bluhm Court (2207.051), requested to purchase or a lease a portion of an adjoining City owned lot at S75 W13950 Bluhm Drive (2207.997.009) for the installation of a basketball court, and WHEREAS, The Public Utilities Committee agreed to sell Mr. May a 70’ x 160’ piece of land at their October 20, 2008 meeting for $10,100 plus closing costs, and WHEREAS, Before any City land can be sold privately, the Planning Commission must first make a determination, and WHEREAS, The City lot is about 2.5 acres in size and the main use of the property is for sewer lift station controlled by the Utilities Department, and WHEREAS, The specific portion of the property that the petitioner is requesting to purchase is vacant and there are no future needs for facility expansions on this area of the site. THEREFORE BE IT RESOLVED, That the Plan Commission approves the sale of a portion of City owned lot at S75 W13950 Bluhm Drive (2207.997.009) to Brad May, the property owner of S75 W13880 Bluhm Court (2207.051). BE IT FURTHER RESOLVED, That the Public Utility Committee required a 20’ ingress/egress easement across a portion of this property for access to the remaining portion of the City property. BE IT FURTHER RESOLVED, That a landscape plan must be submitted and approved before the zoning permit can be issued for the basketball court that shows staggered pine trees along the south side of the court. BE IT FURTHER RESOLVED, That since this lot is planned to be used for an accessory purpose and since the lot will not meet the size requirements of the RS-2 zoning district, the newly purchased lot and the existing May lot must be joined together into one lot as part of the closing or immediately after the closing and failure to do so would make this approval void.
