ccr1966183ACCEPTANCE OF CERTAIN LANDS - JEWEL CREST SUBDIVISION - JENSEN RESOLUTION H183 ESTATE 8 WHEREAS, the CITY OF MUSKEGO. Waukesha County, Wisconsin (formerly Town of-Muskego), was named as a contingent grantee in that certain Deed, dated July 2, 1946, from Edward J. Jensen and Olga Jensen, his Episcopal Church of Wisconsin, and recorded on the 8th day of July, wife, to the trustees of the funds and properties of the Protestant the following described real estate: 1946, in Volume 412 of Deeds on page 65, Waukesha County, and covering Lot numbered Sixty-Two (621, in Block numbered Twenty (20) in Jewel Crest Subdivision, a part of the !\lorthwest One-quarter (NW 1/4) of the Scuthwest One-quarter (SW 1/41 of Section numbered Four (b), Township numbered Five (5) North, of Range numbered Twenty (20) East; also a part of the Southwest One- Quarter (SW 1/4) of the Northwest One-quarter (NW 1/41 of Section numbered Four (4), Town of Muskego, Waukesha County, Wisconsin; WHEREAS, said contingent grant was based upon the restriction that if title was vested in the said City of MuskeEo, the land should be used for church and community purposes only; and WHEREAS, said Deed further provided that if the City of Muskego re- fused to accept the same, title was to vest in the living heirs of the grantors; and WHEREAS, the City of Muskego refused to accept the real estate with the restrictions set forth; and WHEREAS, the Grantee under said Deed has offered to convey the same without restriction and has agreed that it will also furnish quit claim deeds from the living heirs of the grantors; and WiEREAS, the grantee of the aforementioned Deed has also offered to give the said City a quit c1aj.m deed of the following described real estate: 0 e Possible strip of land at the West end of Jewel Crest Subdivision; that is, on the West side of Gold Street and also a triangle piece of land designated play ground between Silver Street, Diamond Street and Agate Avenue ana 100 foot strip of land known as Community Park between Blocks 7 and 8 and a 50 foot strip of land at the end of Park Street, adjoining Jewel Creek and also the bridge crossing Jewel Creek; NOW, THEREFORE, EE IT RESOLVED that the City of Muskego does accept the said real estate described above without restrictions as to use. Jensen has offered to the City by disclaims or quit claim deed a strip of land at the west end of Jewel Crest subdivision located on the west side of Gold Dr. and a triangle piece of land designated playground between Silver, Diamond and Agate Streets and a 100' strip of land known as community park between blocks 7 and 8 and a 50" strip of land at the end of Park St. and the bridge crossing Jule Creek, and WHEREAS the Public Works Committee has recommended acceptance of this land, THEREFORE BE IT RESOLVED that the Common Council of the City of Muskego does hereby authorize the City Attorney to draft the necessary legal documents in order that certain lands in the Jewel Crest Subdivision may be turned over to the City of Muskego and does durther authorize the Mayor and the Clerk to execute such documents.
